Yet, REFR actually performed fairly well this week, just not well enough.  REFR is no longer in the Terrible Twos.  Though it is not far away.  Still no dividends from REFR  Will REFR slowly dwindle away?  Will REFR crash and burn all at once?  There seems to be some discontent among REFR longs these days, at least this is my impression.  Remember, REFR still has some value, as you can sell the stock and deduct the losses from gains on your other investments.  (You do have other investments, don't you?).  Unless you held your REFR in an IRA.  I think this is a very bad move.  Highly speculative penny stocks like REFR should be held in a taxable account, so you can deduct your losses.  Save your IRAs for quality investments. Great timing on an article to pump this dead as a rock POS.&lt;br&gt;Product Price Regression to the mean is not a growth model that gets you To profitability. The “brag” in the article is the total volume of SPD year to day exceeds the volume of last year.....but the revenue is static with last year...SO MUCH WINNING.&lt;br&gt;AND OPERATING COSTS ARE THE SAME AS LAST YEAR.&lt;br&gt;&lt;br&gt;And Joe H has to keep what is or IS NOT happening secret. No one has to tell REFR until they “do it” ( or could they just use SPD and not tell anybody? And attached to the predictions is a timeline.&lt;br&gt;&lt;br&gt;Dixon&amp;#39;s comments and replies are pure conjecture, it is only opinion that is neither supported by facts or testable (and that the CEO says something in a CC does not make what he says factual, the only fact is that he said something that he at that time represented as a fact--&lt;i&gt;whether true or not&lt;/i&gt;). Moreover when Longs predicts something there is no test or time line that suggests &lt;i&gt;by when&lt;/i&gt; her prediction will occur (that troublesome REFRspeak word, &lt;i&gt;soon)&lt;/i&gt;.&lt;br&gt;&lt;br&gt;I believe that what Dixon, and others that do not agree with my posts, fail to understand is that some of us have a respect for integrity in what we do and say. Furthermore, we demand that integrity in others. And that we are irritated and annoyed when we accepted what someone in authority (the CEO in this case) said and then it becomes apparent that they either knowingly lied and misrepresented what they stated or were such charlatans to not explain that what they offered as facts were just &lt;i&gt;hoped for conjecture&lt;/i&gt; under the slimy guise of Safe Harbor.&lt;br&gt;&lt;br&gt;That I am long or short or just annoyed is immaterial to the case I make. The hard story is that this is a &lt;b&gt;failed &lt;/b&gt;company under the simple tests of 1) negative growth in sales for 4 years 2) no internal rate of return on invested capital or profitability--constant cash burn 3) no demonstrated expansion in the markets use of the SPD product 4) no expansion in the film makers (i.e. in North America).&lt;br&gt;&lt;br&gt;You state the Shorts are manipulating the stock, obviously walking it down you say, but you do not expect any reduction in the short interest? Bernie Sanders in the Democratic primary, DSA memos show.&lt;/b&gt;&lt;b&gt;The DSA may not support the Democratic nominee if someone other than Sanders wins the primary.&lt;/b&gt;&lt;b&gt;One memo cited “developing propaganda” as a “primary task of the national DSA Bernie campaign.” &lt;/b&gt;&lt;b&gt;Another memo stressed the “need to agitate for Sanders” among “rank-and-file union members.”&lt;/b&gt;The Democratic Socialists of America (DSA) have yet to publicly endorse Vermont Sen. Bernie Sanders, but for months they have been laying the groundwork to campaign for Sanders, and only Sanders, in the Democratic primary, planning documents obtained by The Daily Caller News Foundation show.&lt;br&gt;&lt;br&gt;The DSA played a key role in  &lt;a href='https://dailycaller.com/2018/07/05/marxist-radicals-democratic-party/' target='_blank'&gt;helping left-wing Democratic candidates,&lt;/a&gt; like fellow DSA member New York Rep. Alexandria Ocasio-Cortez,  &lt;a href='https://www.axios.com/democratic-socialist-candidates-who-have-won-in-2018-midterms-6bf604a3-ee98-4ab3-9e63-349aec324c43.html' target='_blank'&gt;topple establishment Democrats&lt;/a&gt; in 2018 primary races. DSA leaders are looking to replicate that success at the national level.&lt;br&gt;&lt;br&gt;Three planning documents that were circulated among DSA members in January before Sanders’s  &lt;a href='https://dailycaller.com/2019/02/19/bernie-sanders-run-president-2020/' target='_blank'&gt;Feb. 19 announcement&lt;/a&gt; lay out the DSA’s two primary goals for 2020: do everything possible to help Sanders win while using his campaign to legitimize the democratic socialist movement within American politics. The documents are included in full at the bottom of this article.&lt;br&gt;&lt;br&gt;The DSA has yet to formally endorse Sanders. The national planning committee has a vote  &lt;a href='https://www.dsausa.org/bernie-2020-dsa-endorsement-debate-process/' target='_blank'&gt;scheduled&lt;/a&gt; for March 21, but the planning memos treat the endorsement as a foregone conclusion.&lt;br&gt;&lt;br&gt;The DSA won’t consider endorsing any “other candidate in the Democratic primaries,” according to a January 2019 exploratory report, which notes that the DSA began laying the groundwork to support  &lt;a href='https://dailycaller.com/2019/02/23/bernie-sanders-new-hampshire-poll/' target='_blank'&gt;Sanders’s campaign&lt;/a&gt; well ahead of its launch.&lt;br&gt;&lt;br&gt;“If DSA is to play an important role in Sanders’s campaign — both growing DSA as a serious, independent, socialist pole in the broader Sanders movement, and helping Sanders win the Democratic Party primary and go on to defeat Trump in the general election — then it is essential that DSA get involved in this campaign as early as possible,” the report states.&lt;br&gt;&lt;br&gt;The DSA’s pro-Sanders campaign “will have its own national campaign infrastructure, independent from Sanders’s official campaign,” according to the report, which left open the possibility that the socialists “will coordinate with the official [Sanders] campaign.”&lt;br&gt;&lt;br&gt;As a DSA chapter co-chair I just wanna set the record straight for a minute: communism is good&lt;br&gt;&lt;br&gt;— Olivia Katbi Smith??????? ????? (Photo by Sean Rayford/Getty Images)&lt;br&gt;&lt;br&gt;The DSA plans to repurpose its Medicare for All campaign towards helping Sanders win the primary, according to another memo, which was prepared by the DSA’s Medicare for All steering committee.&lt;br&gt;&lt;br&gt;The committee “believes that we should turn a good deal of our campaign infrastructure toward a DSA Bernie 2020 campaign when and if DSA endorses,” according to the memo. “DSA’s Medicare for All campaign has spent a year developing a national organizing infrastructure that can be utilized in DSA’s campaign for Bernie Sanders.”&lt;br&gt;&lt;br&gt;“In many DSA chapters, the Medicare for All campaign or Health Justice Working Group represents the best springboard for Bernie 2020 work: these chapters have been involved in mass outreach and canvassing work around a proposal closely associated with Sanders’ name,” the memo continues.&lt;br&gt;&lt;br&gt;The memo describes the DSA’s Medicare for All campaign as “unique within DSA for its ability to organize on a national level, and the infrastructure built through the campaign will be essential to running a cohesive campaign for Bernie Sanders.” &lt;b&gt; &lt;a href='https://dailycaller.com/2018/07/05/marxist-radicals-democratic-party/' target='_blank'&gt;(RELATED: Marxists And Extreme Radicals Seek To Take Over The Democratic Party)&lt;/a&gt;&lt;/b&gt;&lt;br&gt;&lt;br&gt;Steering union members towards Sanders and away from establishment Democrats is a key objective of that campaign.&lt;br&gt;&lt;br&gt;“The Bernie campaign gives us an opportunity to talk to rank-and-file union members and we should take that opportunity,” the memo states. “Union leadership will be slow to come out in support of Sanders because they feel tied to the Democratic Party establishment.”&lt;br&gt;&lt;br&gt;“We need to agitate for Sanders among rank-and-file members in the hopes of building DSA’s ties to those members and pushing more unions to support Sanders this time around,” the memo continues.&lt;br&gt;&lt;br&gt;“DSA’s chapters have spent the last few years building closer relationships to their local unions through Medicare for All coalitions; the Medicare for All regional organizers are well equipped to facilitate this aspect of the campaign.”&lt;br&gt;&lt;br&gt;DSA spokesman Lawrence Dreyfuss didn’t return an interview request.&lt;br&gt;&lt;br&gt;The DSA’s youth arm, Young Democratic Socialists of America (YDSA), is gearing up to support Sanders as well. YDSA passed a resolution at its 2018 summer convention to develop “a comprehensive plan for YDSA to actively support Sanders’s campaign in the event that he runs.”&lt;br&gt;&lt;br&gt;The DSA’s national coordinating committee aims to “cohere YDSA’s existing national priorities with Bernie’s political platform in order to build a strong, independent student campaign for Bernie 2020,” according to the committee’s campus campaign plan. That&amp;#39;s turning out to be the motto at wearable tech maker Xybernaut (NASDAQ:XYBR), which released the following, rather curious  &lt;a href='https://quotes.fool.com/custom/fool/html-news.asp?guid=%7BAF41E8D2-51A0-4D9C-8C1A-1ED7F92CBDC1%7D&amp;amp;currticker=xybr&amp;amp;symbols=xybr&amp;amp;nx=37942.3854166667-809810051&amp;amp;bx=' target='_blank'&gt;earnings announcement&lt;/a&gt; back in November:&lt;/b&gt;&lt;br&gt;&lt;br&gt;"The net loss for the third quarter of 2003 decreased 41% to $4.7 million from the third quarter of 2002. The net loss per share also decreased to $0.03 per share from $0.10 per share in the prior year."&lt;br&gt;&lt;br&gt;Now, hold on a sec. What was that again?&lt;br&gt;&lt;br&gt;The net loss decreased 41%. So, Xybernaut lost 41% less money this third quarter than it did in the third quarter one year ago. Sounds pretty good, aside from the fact that the company&amp;#39;s still losing money.&lt;br&gt;&lt;br&gt;But wait! There&amp;#39;s even better news. The net loss &lt;i&gt;per share&lt;/i&gt; shrank 70%! That means long-term Xybernaut shareholders who last year saw a loss of 10 cents for each share they owned are probably delighted this year to see their company only lose 3 cents a share. Things are clearly looking up for this developer of portable computers and related software.&lt;br&gt;&lt;br&gt;Or are they? How does a company lose X dollars as a whole, but a whole lot less than X dollars per share?&lt;br&gt;&lt;br&gt;By diluting the bejeezus out of the long-term shareholders.&lt;br&gt;&lt;br&gt;It only takes a glance at the press release to see what happened -- you don&amp;#39;t even need to hunt through the filings on  &lt;a href='http://www.freeedgar.com/search/ViewFilings.asp?CIK=1013148&amp;amp;Directory=950133&amp;amp;Year=03&amp;amp;SECIndex=3875&amp;amp;Extension=.tst&amp;amp;PathFlag=0&amp;amp;TextFileSize=156883&amp;amp;SFType=&amp;amp;SDFiled=&amp;amp;DateFiled=11/13/2003&amp;amp;SourcePage=FilingsResults&amp;amp;UseFrame=1&amp;amp;OEMSource=&amp;amp;FormType=10-Q&amp;amp;Co' target='_blank'&gt;FreeEdgar&lt;/a&gt; to find it. The first table in the press release has an entry for "Weighted average shares outstanding" for the three months ended Sept. 30, 2002, and for the same period in 2003. In 2002, &lt;b&gt;Xybernaut had 78,011,017 shares outstanding. By Sept. 30, 2003, that number had more than doubled to 158,635,685 -- for a grand total of 103.3% annual share dilution.&lt;br&gt;&lt;br&gt;And if you double your shares outstanding, you halve your losses per share.&lt;/b&gt;&lt;br&gt;&lt;br&gt;However, share dilution is a double-edged sword. On the one hand, it can make your losses, per share, look better than they are on a company-wide basis. But if things turn around, and the company starts making a profit, then that profit gets divvied up among all the extra shares, too. Shareholders currently tickled at the narrowing losses per share may be less than thrilled when they see what 103.3% dilution does to their per-share profits.&lt;br&gt;&lt;br&gt;&lt;i&gt; &lt;a href='mailto:r.h.smith@cox.net' target='_blank'&gt;Rich Smith&lt;/a&gt; &lt;/i&gt;&lt;i&gt;owns no shares of Xybernaut. The conceit of Harary&amp;#39;s vision of REFR as the "royalty collecting, dividend paying machine" is that there&amp;#39;s just one more hill to climb, they just have to get over the break-even point, and REFR shareholders get to feast on shrimp and crab balls on their private yachts in perpetuity thereafter.&lt;br&gt;&lt;br&gt;Back in the real world, though, it just isn&amp;#39;t that simple. Hitachi is not here to put REFR&amp;#39;s interests ahead of their own. If they really have managed to turn the proverbial sow&amp;#39;s ear that is REFR&amp;#39;s SPD technology into a silk purse of something actually marketable, they&amp;#39;re not going to just hand over a big cut of the profits to a company that contributed nothing to that effort, if there&amp;#39;s anything they can do about it.&lt;br&gt;&lt;br&gt;And it is most emphatically &lt;b&gt;not &lt;/b&gt;necessary to concede Hitachi has succeeded in doing this, before pointing out that argument exists as a backup to the long-running bear case in REFR.&lt;br&gt;&lt;br&gt;But go ahead, keep bidding up that stock. According to the SEC&amp;#39;s complaint filed in the United States District Court for the Southern District of New York, Ronk touted the issuers&amp;#39; illusory business prospects and made revenue projections without any basis in fact. As Ronk solicited investors to privately invest in Casablanca and Gepco, he also secretly schemed to create the appearance of market interest and a rising share price in their stocks. Further, Ronk allegedly recruited the owner of a boiler room to induce buyers to purchase shares at higher prices. According to the complaint, this manipulative trading temporarily drove up Casablanca and Gepco&amp;#39;s stock prices and enhanced the credibility of the issuers while Ronk&amp;#39;s capital raising efforts were ongoing.&lt;br&gt;&lt;br&gt;The complaint further alleges that Ronk engaged in a fraudulent offering of securities in a private company, Wealthmakers, Ltd. Among other things, Ronk, an owner and co-founder of Wealthmakers, misled investors about trading returns that Wealthmakers purportedly generated, along with the amount of seed capital invested by Ronk and other officers of the company.&lt;br&gt;&lt;br&gt;The Commission charged Ronk with violating the antifraud provisions of Section 17(a) of the Securities Act of 1933 and Section 10(b) of the Securities Exchange Act of 1934 and Rule 10b-5 thereunder, as well as the anti-touting provisions of Section 17(b) of the Securities Act. About six weeks later, the bank abruptly said it was restricting clients&amp;#39; sales of penny stocks, then amended that policy to give financial advisers more time to exit positions, the people said. &lt;br&gt;&lt;br&gt;Penny stocks, which the Securities and Exchange Commission defines as a small company trading for less than $5 a share and on an over-the-counter market, occupy a disreputable corner of financial markets. Since the shares are thinly traded away from major exchanges and face few disclosure requirements, they have for decades been a tool for fraudulent schemes. One common approach is the pump-and-dump where criminals hype a stock before exiting positions. That was the method Jordan Belfort, the so-called Wolf of Wall Street, used to enrich himself before getting caught. &lt;br&gt;&lt;br&gt;Regulators have increasingly made their views of penny stocks known. The SEC&amp;#39;s Division of Economic and Risk Analysis published a  &lt;a href='https://www.sec.gov/dera/staff-papers/white-papers/16dec16_white_outcomes-of-investing-in-otc-stocks.html' target='_blank'&gt;white paper&lt;/a&gt; in 2016 highlighting the risks of investing in over-the-counter markets. The majority of investors lose money in the trades, and losses worsened for stocks that were the subject of promotional campaigns and those that had weaker disclosures, the SEC said.&lt;br&gt;&lt;br&gt;Bank of America is first&lt;br&gt;Bank of America appears to be the first major wirehouse to institute an outright ban on the purchase of penny stocks. While other firms have review processes for these riskier trades, it&amp;#39;s still possible to buy penny stocks at Morgan Stanley and UBS, according to people with knowledge of those firms&amp;#39; policies.&lt;br&gt;&lt;br&gt;The move is the latest example of Bank of America pulling back on potentially risky activities. CEO Brian Moynihan has spent much of his tenure spending billions of dollars securing settlements with regulators. He often repeats his "responsible growth" mantra, and signs of the impact of that strategy abound.&lt;br&gt;&lt;br&gt;In February, the bank halted clients from using credit cards to purchase bitcoin and other cryptocurrencies. The firm&amp;#39;s investment banking head, Christian Meissner, reportedly left earlier this month after clashing with Moynihan over the division&amp;#39;s risk appetite. &lt;br&gt;&lt;br&gt;Still, the policy shift around penny stocks at Bank of America has sown confusion among some of the firm&amp;#39;s 17,442 financial advisers.&lt;br&gt;&lt;br&gt;"We were told to get rid of them by a certain date," said one Merrill Lynch broker. "I called compliance today to say my client doesn&amp;#39;t want to do that. Now they&amp;#39;re telling me he doesn&amp;#39;t have to sell, but it could be hard to get rid of it down the road."&lt;br&gt;&lt;br&gt;After initially banning the sale of most penny stocks, the firm put the policy under review, allowing most of them to be sold for at least the time being, according to one of the sources. Only the riskiest penny stocks that already may be the target of fraudulent schemes — labeled with a  &lt;a href='https://www.otcmarkets.com/learn/caveat-emptor' target='_blank'&gt;skull-and-crossbones&lt;/a&gt; icon by the trading firm OTC Markets Group — can no longer be sold. Eventually, all penny stocks could fall under the restriction, the person said.&lt;br&gt;&lt;br&gt;Clients who can no longer sell penny stocks through Merrill Lynch have to transfer them to another brokerage to liquidate the positions. Some clients have had difficulty selling their holdings at rival brokerages, which are beginning to place restrictions on the asset class, according to one of the people.&lt;br&gt;&lt;br&gt;Under $5&lt;br&gt;The bank sent clients another letter earlier this month. Starting Sunday, stocks priced under $5 per share from companies with a market capitalization under $300 million will be subject to a regulatory review, according to a copy obtained by CNBC. Clients who want to sell "will experience a delay in execution" because of the review, the firm said.&lt;br&gt;&lt;br&gt;The bank took steps regarding low-priced stocks "to ensure we are complying with Securities and Exchange Commission regulations and protecting the interests of our clients," said Jerry Dubrowski, a spokesman for the bank. "As a result, certain transactions may be subject to restrictions, trading prohibitions or other limitations."&lt;br&gt;&lt;br&gt;Penny stocks are illiquid and can easily be manipulated for fraudulent purposes, according to talking points distributed to Merrill Lynch brokers. The asset class is rife with companies with shaky businesses. Other times, they are legitimate companies that have been delisted from major exchanges as they near bankruptcy. &lt;br&gt;&lt;br&gt;Still, the high volatility of the asset class — in which shares worth a few pennies can rocket in value — invariably lures retail investors. &lt;br&gt;&lt;br&gt;That happened in July 2014 with Cynk Technology, when a company with no discernible assets, revenue and a single employee surged from 6 cents a share to $21.95, or a market cap of more than $6 billion. The next year, a Canadian citizen named Philip Kueber was accused by U.S. authorities of engaging in a $300 million stock manipulation fraud. &lt;br&gt;&lt;br&gt;According to the SEC&amp;#39;s 2016 white paper, retired, low income and less-educated investors fared the worst with penny stocks.
