Global race for rare earths comes to Kenya’s Mrima Hill

KWALE, Kenya: Division and suspicion have gripped five villages near Kenya’s coast as global powers from the United States to China eye a forest that is rich in rare earths — minerals vital to high-tech and low-carbon industries.

The US government under President Donald Trump has made securing critical minerals central to its diplomacy in Africa, including through a peace deal in the resource-rich Democratic Republic of Congo this year.

Mrima Hill — a forest of around 390 acres near Kenya’s Indian Ocean coastline — could be another target.

It sits quietly on huge rareearth deposits that Cortec Mining Kenya, a subsidiary of UK and Canada-based Pacific Wildcat Resources, estimated in 2013 were worth US$62.4 billion, including large stores of niobium, used to strengthen steel.

US official Marc Dillard visited the hill in June when he was serving as the interim ambassador to Kenya.

Other foreigners also attempted to visit in recent months, including Chinese nationals who were turned away, according to Juma Koja, a guard for the Mrima Hill community.

An Australian consortium of mining firms RareX and Iluka Resources announced a bid this year to mine rare earths on the site, and locals say land speculators are flocking to the area.

Buried riches

The interest is worrying the community, mostly of the Digo ethnic group, who fear they will be evicted or denied a share in future mining windfalls.

The lush forest is home to their sacred shrines and has long supported farming and livelihoods, though today more than half the population lives in extreme poverty, according to government data.

AFP was initially barred access to the forest.

“People come here with big cars... but we turn them away,” said Koja.

His stance stems from past encounters with prospective investors — a process he says was not transparent.

“I do not want my people to be exploited,” he said.

Kenya revoked a mining licence in 2013 that had been granted to Cortec Mining Kenya, citing environmental and licensing irregularities.

Cortec claimed in court that the licence was revoked after it refused to pay a bribe to then mining minister Najib Balala, an allegation he denied.

The company lost multiple legal efforts over the revocation.

In 2019, Kenya imposed a temporary ban on new mining licences over concerns about corruption and environmental degradation.

But it now sees a major opportunity, particularly as China — the biggest source of rare earths — increasingly limits its exports.

Kenya’s mining ministry announced “bold reforms” this year, including tax breaks and improved licensing transparency, aimed at attracting investors and boosting the sector from 0.8 per cent of GDP to 10 percent by 2030.

Daniel Weru Ichang’i, a retired economic geology professor at the University of Nairobi, said Kenya had a long way to go, especially in gathering reliable data on its resources.

“There’s a romantic view that mining is an easy area, and one can get rich quickly... We need to sober up,” he told AFP.

“Corruption makes this area, which is very high-risk, less attractive to invest in.”

Competition between the West and China is driving up prices, but if the country wants to profit, it “must stick to the law, and individual interests must be subjugated to that of the nation,” he said.

‘Mrima is our life’

On Mrima Hill, locals worry for their livelihoods, sacred shrines, medicinal plants, and the forest they have known all their lives.

“This Mrima is our life... Where will we be taken?” said Mohammed Riko, 64, vice chairman of the Mrima Hill Community Forest Association.

Koja is concerned about the loss of unique indigenous trees like the giant orchid, already a problem before mining has even started.

“In my heart I am crying. This Mrima has endangered species that we are losing,” he said.

But others, like Domitilla Mueni, treasurer of the Mrima Hill association, see an opportunity.

She has been developing her land — planting trees, farming — in order to push up the value when mining companies come to buy.

“Why should we die poor while we have minerals?” she said. — AFP

A new US-backed consortium, including Mrima Earth Ltd, has submitted a proposal to Kenya’s National Mining Corporation (Namico) to develop the long-stalled Mrima Hill mining site, a rare earths and niobium deposit, aiming to shift the site towards a value-chain, domestically processed model, according to The Standard.

The Mrima Earth Consortium is majority-owned by US shareholders and backed by North American institutional investors as well as a major, unnamed US strategic partner. It is led by a globally experienced management team, including a technical head who formerly served as managing director of Molycorp’s Mountain Pass rare earth project in California, now operated by MP Materials (NYSE:MP).

“Breaking from the trend of companies focused solely on raw ore export, the Mrima Earth Consortium plans to develop the resource in stages with a strong emphasis on creating a value-added product in Kenya,” the firm is quoted as saying in its prospect to Namico.

“Plans include extensive knowledge transfer, skills development, training programmes, and long-term job creation aimed at ensuring that the region—and Kenya as a whole—benefits directly from the project’s growth.”

In its prospectus to Namico, Mrima Earth said its approach could inject “billions of dollars” into Kenya’s economy while supporting downstream industrialisation. The firm argues that a local processing chain would strengthen the country’s position in global rare-earth supply networks, where demand continues to grow amid tightening geopolitical competition.

The government views the Mrima Hill deposit in Kwale County as a strategic critical minerals asset. Previous investors in the hill included Cortec Mining — the former licence holder whose parent, Pacific Wildcat Resources (formerly TSX-V:PAW), is now defunct — while Australian firms RareX (ASX:REE) and Iluka Resources (ASX:ILU) have expressed sustained interest.

Mrima Hill has been at the centre of repeated licensing disputes over the past decade. The proposed entry of Mrima Earth marks the latest attempt to revive development of the deposit, which has long been cited as a potential anchor for a regional rare earths industry.

Legal claims by Cortec Mining, whose licence was revoked in 2013, remain active in arbitration channels. The government maintains the revocation was justified under updated mining regulations and that any future licensing arrangements must comply with Kenya’s modernised legal and environmental framework.

Officials have signalled that the state intends to ensure greater oversight of strategic mineral sites, consistent with the Mining Act and recent policy reviews. Authorities have also emphasised that future project development will require stricter due diligence, transparent ownership disclosures and stronger community-engagement provisions.

Even if you win your billion dollars... doesn't mean you're going to get a dime...

The global economic order seemed to take a huge leap forward as the international arbitration entities appeared to be giving a new chance of leveling the playing field... to give capital a chance to survive contact with the flagrant corruption of officialdom...

These days... with a couple of years of effort... that's looking more and more to be a tad overly optimistic...

Not only are the arbitration panels themselves quickly become as subject to the influence of corruption as the originating sources... there's also still all kinds of obstacles to enforcement of a fully legitimate judgement...

Few seem to be talking about the implications... which will include reeling back in a lot of the expansion of capital that has been pushed out into the less developed world... if not only the local political risks are unabated... but the arbitration processes prove incompetent in delivering a RESULT in a judgement.

There's no other apparent movement in the related issues I can see, since January... when a Delaware judge over-ruled the U.S. government's action suspending collection in the Crystallex case

I've not found anything more recent in the news about that... but will dig into the Delaware courts and see what I can find. Crystallex went private so they're not talking. The other related issue with a billion dollar judgement is Gold Reserve...

The optimal outcome seems it would be one that includes a negotiated element in a REASONABLE settlement that avoids locking it up in a perpetual cycle of arbitration... while any such settlement has to both 1) be fully consistent with the law and 2) result in fair treatment of Cortec under the law, without any settlement becoming a vehicle for enabling local corruption or the corruption of government ministers, judges, etc.

What actually does happen will likely depend not only on the outcome in the ruling made on the annulment, but also on the nature and character of the substance and the reasoning behind their taking up the case, first, and accepting the appeal seeking the annulment... if they do annul the award.

Kenya might find it inconvenient to object and continue the dispute through another round of arbitration if there's a risk in "dirty laundry" from the first round being aired... not as a result of the decision made... but as a result of Kenya sustaining the dispute.

Otherwise, I've not kept up with the local news well enough to have any feel for how the situation in the political alignments might have changed in the time while this has been tied up in arbitration. Neither The Star nor The Standard have any recent news items I can find.

But, while poking at it I did note that Clifford Chance has another client, Titanium International... with a similar dispute ongoing with Egypt:

The rules mentioned in item 238 mean only that they've heard the arguments... and that part of the case is done now. Next they'll mull it over until they decide, and them come out with an announcement of a ruling. A decision that is favorable for Cortec will have them annul some or all of the prior award... but, if Kenya wants to persist in their prior objections they can, and then the impact of that "favorable" outcome will be to return it to where it was before the original dispute was taken up, so, basically, could mean starting the same dispute resolution process all over again as if the last round had never happened...

Resubmission of Dispute after an Annulment

(1) If a Committee annuls part or all of an award, either party may request the resubmission of the dispute to a new Tribunal. Such a request shall be addressed in writing to the Secretary-General and shall:
