Divi&amp;#173;sion and sus&amp;#173;pi&amp;#173;cion have gripped five vil&amp;#173;lages near  Kenya’s coast as global powers from the United States to China eye a  forest that is rich in rare earths — min&amp;#173;er&amp;#173;als vital to high-tech and  low-car&amp;#173;bon indus&amp;#173;tries.&lt;br&gt;&lt;br&gt;The US gov&amp;#173;ern&amp;#173;ment  under Pres&amp;#173;id&amp;#173;ent Don&amp;#173;ald Trump has made secur&amp;#173;ing crit&amp;#173;ical min&amp;#173;er&amp;#173;als  cent&amp;#173;ral to its dip&amp;#173;lomacy in Africa, includ&amp;#173;ing through a peace deal in  the resource-rich Demo&amp;#173;cratic Repub&amp;#173;lic of Congo this year.&lt;br&gt;&lt;br&gt;Mrima Hill — a forest of around 390 acres near Kenya’s Indian Ocean coast&amp;#173;line — could be another tar&amp;#173;get.&lt;br&gt;&lt;br&gt;It  sits quietly on huge rareearth depos&amp;#173;its that Cortec Min&amp;#173;ing Kenya, a  sub&amp;#173;si&amp;#173;di&amp;#173;ary of UK and Canada-based Pacific Wild&amp;#173;cat Resources,  estim&amp;#173;ated in 2013 were worth US$62.4 bil&amp;#173;lion, includ&amp;#173;ing large stores  of niobium, used to strengthen steel.&lt;br&gt;&lt;br&gt;US offi&amp;#173;cial Marc Dillard vis&amp;#173;ited the hill in June when he was serving as the interim ambas&amp;#173;sador to Kenya.&lt;br&gt;&lt;br&gt;Other  for&amp;#173;eign&amp;#173;ers also attemp&amp;#173;ted to visit in recent months, includ&amp;#173;ing  Chinese nation&amp;#173;als who were turned away, accord&amp;#173;ing to Juma Koja, a  guard for the Mrima Hill com&amp;#173;munity.&lt;br&gt;&lt;br&gt;An  Aus&amp;#173;tralian con&amp;#173;sor&amp;#173;tium of min&amp;#173;ing firms RareX and Iluka Resources  announced a bid this year to mine rare earths on the site, and loc&amp;#173;als  say land spec&amp;#173;u&amp;#173;lat&amp;#173;ors are flock&amp;#173;ing to the area.&lt;br&gt;&lt;br&gt;&lt;b&gt;Bur&amp;#173;ied riches&lt;/b&gt;&lt;br&gt;&lt;br&gt;The  interest is wor&amp;#173;ry&amp;#173;ing the com&amp;#173;munity, mostly of the Digo eth&amp;#173;nic  group, who fear they will be evicted or denied a share in future min&amp;#173;ing  wind&amp;#173;falls.&lt;br&gt;&lt;br&gt;The lush forest is home to their  sac&amp;#173;red shrines and has long sup&amp;#173;por&amp;#173;ted farm&amp;#173;ing and live&amp;#173;li&amp;#173;hoods,  though today more than half the pop&amp;#173;u&amp;#173;la&amp;#173;tion lives in extreme poverty,  accord&amp;#173;ing to gov&amp;#173;ern&amp;#173;ment data.&lt;br&gt;&lt;br&gt;AFP was ini&amp;#173;tially barred access to the forest.&lt;br&gt;&lt;br&gt;“People come here with big cars... but we turn them away,” said Koja.&lt;br&gt;&lt;br&gt;His stance stems from past encoun&amp;#173;ters with pro&amp;#173;spect&amp;#173;ive investors — a pro&amp;#173;cess he says was not trans&amp;#173;par&amp;#173;ent.&lt;br&gt;&lt;br&gt;“I do not want my people to be exploited,” he said.&lt;br&gt;&lt;br&gt;Kenya  revoked a min&amp;#173;ing licence in 2013 that had been gran&amp;#173;ted to Cortec  Min&amp;#173;ing Kenya, cit&amp;#173;ing envir&amp;#173;on&amp;#173;mental and licens&amp;#173;ing  irreg&amp;#173;u&amp;#173;lar&amp;#173;it&amp;#173;ies.&lt;br&gt;&lt;br&gt;Cortec claimed in court  that the licence was revoked after it refused to pay a bribe to  then &amp;#173;min&amp;#173;ing min&amp;#173;is&amp;#173;ter Najib Balala, an alleg&amp;#173;a&amp;#173;tion he denied.&lt;br&gt;&lt;br&gt;The com&amp;#173;pany lost mul&amp;#173;tiple legal efforts over the revoc&amp;#173;a&amp;#173;tion.&lt;br&gt;&lt;br&gt;In  2019, Kenya imposed a tem&amp;#173;por&amp;#173;ary ban on new min&amp;#173;ing licences over  con&amp;#173;cerns about cor&amp;#173;rup&amp;#173;tion and envir&amp;#173;on&amp;#173;mental degrad&amp;#173;a&amp;#173;tion.&lt;br&gt;&lt;br&gt;But  it now sees a major oppor&amp;#173;tun&amp;#173;ity, par&amp;#173;tic&amp;#173;u&amp;#173;larly as China — the  biggest source of rare earths — increas&amp;#173;ingly lim&amp;#173;its its exports.&lt;br&gt;&lt;br&gt;Kenya’s  min&amp;#173;ing min&amp;#173;istry announced “bold reforms” this year, includ&amp;#173;ing tax  breaks and improved licens&amp;#173;ing trans&amp;#173;par&amp;#173;ency, aimed at attract&amp;#173;ing  investors and boost&amp;#173;ing the sec&amp;#173;tor from 0.8 per cent of GDP to 10  per&amp;#173;cent by 2030.&lt;br&gt;&lt;br&gt;Daniel Weru Ichang’i, a  retired eco&amp;#173;nomic geo&amp;#173;logy pro&amp;#173;fessor at the Uni&amp;#173;versity of Nairobi,  said Kenya had a long way to go, espe&amp;#173;cially in gath&amp;#173;er&amp;#173;ing reli&amp;#173;able  data on its resources.&lt;br&gt;&lt;br&gt;“There’s a romantic view that min&amp;#173;ing is an easy area, and one can get rich quickly... We need to sober up,” he told AFP.&lt;br&gt;&lt;br&gt;“Cor&amp;#173;rup&amp;#173;tion makes this area, which is very high-risk, less attract&amp;#173;ive to invest in.”&lt;br&gt;&lt;br&gt;Com&amp;#173;pet&amp;#173;i&amp;#173;tion  between the West and China is driv&amp;#173;ing up prices, but if the coun&amp;#173;try  wants to profit, it “must stick to the law, and indi&amp;#173;vidual interests  must be sub&amp;#173;jug&amp;#173;ated to that of the nation,” he said.&lt;br&gt;&lt;br&gt;&lt;b&gt;‘Mrima is our life’&lt;/b&gt;&lt;br&gt;&lt;br&gt;On  Mrima Hill, loc&amp;#173;als worry for their live&amp;#173;li&amp;#173;hoods, sac&amp;#173;red shrines,  medi&amp;#173;cinal plants, and the forest they have known all their lives.&lt;br&gt;&lt;br&gt;“This  Mrima is our life... Where will we be taken?” said Mohammed Riko, 64,  vice chair&amp;#173;man of the Mrima Hill Com&amp;#173;munity Forest Asso&amp;#173;ci&amp;#173;ation.&lt;br&gt;&lt;br&gt;Koja  is con&amp;#173;cerned about the loss of unique indi&amp;#173;gen&amp;#173;ous trees like the  giant orchid, already a prob&amp;#173;lem before min&amp;#173;ing has even star&amp;#173;ted.&lt;br&gt;&lt;br&gt;“In my heart I am cry&amp;#173;ing. It is led by a globally experienced management team, including a technical head who formerly served as managing director of Molycorp’s Mountain Pass rare earth project in California, now operated by MP Materials (NYSE:MP).&lt;br&gt;&lt;br&gt;“Breaking from the trend of companies focused solely on raw ore export, the Mrima Earth Consortium plans to develop the resource in stages with a strong emphasis on creating a value-added product in Kenya,” the firm is quoted as saying in its prospect to Namico.&lt;br&gt;&lt;br&gt;“Plans include extensive knowledge transfer, skills development, training programmes, and long-term job creation aimed at ensuring that the region—and Kenya as a whole—benefits directly from the project’s growth.”&lt;br&gt;&lt;br&gt;In its prospectus to Namico, Mrima Earth said its approach could inject “billions of dollars” into Kenya’s economy while supporting downstream industrialisation. The firm argues that a local processing chain would strengthen the country’s position in global rare-earth supply networks, where demand continues to grow amid tightening geopolitical competition.&lt;br&gt;&lt;br&gt;The government views the Mrima Hill deposit in Kwale County as a strategic critical minerals asset. Previous investors in the hill included Cortec Mining — the former licence holder whose parent, Pacific Wildcat Resources (formerly TSX-V:PAW), is now defunct — while Australian firms RareX (ASX:REE) and Iluka Resources (ASX:ILU) have expressed sustained interest.&lt;br&gt;&lt;br&gt;Mrima Hill has been at the centre of repeated licensing disputes over the past decade. The proposed entry of Mrima Earth marks the latest attempt to revive development of the deposit, which has long been cited as a potential anchor for a regional rare earths industry.&lt;br&gt;&lt;br&gt;Legal claims by Cortec Mining, whose licence was revoked in 2013, remain active in arbitration channels. Committee issues its decision on annulment.&lt;br&gt;&lt;br&gt; &lt;a href='http://icsiddev.prod.acquia-sites.com/cases/case-database/case-detail?CaseNo=ARB/15/29' target='_blank'&gt;Case Details | ICSID (acquia-sites.com)&lt;/a&gt;&lt;/span&gt;</description><link>https://www.siliconinvestor.com/readmsg.aspx?msgid=33262497</link><pubDate>3/30/2021 9:06:46 PM</pubDate></item><item><title>[sense] The optimal outcome seems it would be one that includes a negotiated element in ...</title><author>sense</author><description>&lt;span id="intelliTXT"&gt;The optimal outcome seems it would be one that includes a negotiated element in a REASONABLE settlement that avoids locking it up in a perpetual cycle of arbitration... while any such settlement has to both 1) be fully consistent with the law and 2) result in fair treatment of Cortec under the law, without any settlement becoming a vehicle for enabling local corruption or the corruption of government ministers, judges, etc.&lt;br&gt;&lt;br&gt;What actually does happen will likely depend not only on the outcome in the ruling made on the annulment, but also on the nature and character of the substance and the reasoning behind their taking up the case, first, and accepting the appeal seeking the annulment...  if they do annul the award.    &lt;br&gt;&lt;br&gt;Kenya might find it inconvenient to object and continue the dispute through another round of arbitration if there&amp;#39;s a risk in "dirty laundry" from the first round being aired... not as a result of the decision made... but as a result of Kenya sustaining the dispute.&lt;br&gt;&lt;br&gt;Otherwise, I&amp;#39;ve not kept up with the local news well enough to have any feel for how the situation in the political alignments might have changed in the time while this has been tied up in arbitration. Next they&amp;#39;ll mull it over until they decide, and them come out with an announcement of a ruling. A decision that is favorable for Cortec will have them annul some or all of the prior award... but, if Kenya wants to persist in their prior objections they can, and then the impact of that "favorable" outcome will be to return it to where it was before the original dispute was taken up, so, basically, could mean starting the same dispute resolution process all over again as if the last round had never happened...&lt;br&gt;&lt;br&gt;As per Rule 55:&lt;br&gt;&lt;a class='ExternURL' href='https://icsidfiles.worldbank.org/icsid/icsid/staticfiles/basicdoc/partF-chap07.htm' target='_blank' &gt;icsidfiles.worldbank.org&lt;/a&gt;&lt;br&gt;&lt;br&gt;&lt;b&gt;Resubmission of Dispute after an Annulment&lt;/b&gt;&lt;br&gt;&lt;br&gt;       (1) If a Committee annuls part or all of an award, either party may request          the resubmission of the dispute to a new Tribunal.
