All rights reserved.

The purpose of this board is global economic trend analysis. It will cover commodities such as oil, gold, silver, and copper, as well as currencies, interest rates, and US treasuries. We will attempt to perform cross trend analysis such as but not limited to: how rising or falling interest rates will affect gold, silver, and oil; how a rate cut or hike in Europe might affect a hike or cut in the US; how a falling US$ might affect a rate cut decision in the UK, Europe, or Australia. This board is most interested in interest rate plays in all the major currencies: US$, Euro, Canada, and Australia. We are also interested in major market indicies: US, India, Nikkei, etc, but we are not looking for discussion on individual stocks. Market anlaysis can include what is happening on the housing scene in the US, UK, Australia, etc, fundamental analysis of US treasuries, discussion of commentary from Mauldin, Roach, Fleck or others, and/or technical analysis of currencies, gold or silver. Our aim is to be on the correct side of the great inflation/deflation/stagflation debate that is raging on SI and elsewhere. Our discussion of these global trends will hopfully help us make better investment decisions in light of fluctuating global economic conditions. Thanks, Mish

SI - Mish's Global Economic Trend Analysis

[Haim R. Who is Steve Kirsch? He's a high profile multimillionaire, and one of the most qualified people in the world for crunching numbers and getting the facts.

What was his actual number for the increase? He did a MASSIVE and detailed number crunch, and resolved it to four digits. It cannot be more precise than this:

So how do these numbers add up? HERE IS THE SHORT ANSWER: With only part of the population vaccinated (about half, you can't trust the published numbers but half is a good guess now,) and a baseline of 800,000 heart attacks in an average year in the U.S., after the vax, with only half the population vaxxed, there HAVE TO BE 51,000,000 heart attacks in the U.S. alone from the vax. If you calculate that out to how many people are vaxxed, 1 in 3.5 will have a heart attack, or have had one.

This is damning stuff that is hard to argue with. I would not argue with this guy's numbers, he has, after all, worked a slide rule. He is probably the most qualified man to have ever stepped forward on this issue.

In case you missed the link to his extensive report on this topic HERE IT IS again.Perhaps I am guilty of confirmation bias, but his numbers pretty much match what I have always said - 20-30 million dead which has caused a shortage of workers, even in a depressed economy. With an economy this bad, there should be at least 40 million unemployed. 10 million jobs won't cover that, and there is STILL that many open. Those numbers are at least ballpark to what Kirsch has come up with (because I am not bad at math either). I just used a different data set to get approximately the same numbers. He used athlete casualties, I used the employment stats. That's like results cubed (two separate and independent data sets analyzed by people who don't even know each other producing similar results does a lot more than doubling or multiplying credibility, it more approximately cubes it.)

It not only is a catastrophe already, it is going to get REALLY BAD from here on out.

Over a 60X increase in pro sports adverse events since the vaccines roll...Steve Kirsch

Nobody can explain that. And yet, it was Déjà vu all over again. Just like in the HIV battle—people were never told that the “HIV test” had different standards in different countries, and within countries, from lab to lab. The highest bar (the greatest number of HIV proteins) was in Australia: five. The Lowest was Africa: 2. In the US it is generally 3-4.

We used to joke that you could rid yourself of an “HIV diagnosis” by flying from either the US or Australia, to Africa. But for many years, “AIDS” in Africa was diagnosed without any tests whatsoever. Just a short list of symptoms that tracked precisely with symptoms of most tropical diseases, such as fever, cough, and shortness of breath.

David, in his quiet Canadian way, dropped a bombshell in his next statement:

“I think if a country said, “You know, we need to end this epidemic,” They could quietly send around a memo saying: “We shouldn’t be having the cutoff at 37. If we put it at 32, the number of positive tests drops dramatically. If it’s still not enough, well, you know, 30 or 28 or something like that. So, you can control the sensitivity.”

Yes, you read that right. Labs can manipulate how many “cases’ of Covid-19 their country has. Is this how the Chinese made their case load vanish all of a sudden?

[Joe Btfsplk] A VERY big chunk of governments is in the shake-down business. I have made the case in the American Journal of Epidemiology and in Newsweek that people who have a medical need to be treated can be treated early and successfully with hydroxychloroquine, zinc, and antibiotics such as azithromycin or doxycycline. I have also argued that these drugs are safe and have made that case privately to the Food and Drug Administration.

The pushback has been furious. Dr. Anthony Fauci has implied that I am incompetent, notwithstanding my hundreds of highly regarded, methodologically relevant publications in peer-reviewed scientific literature. A group of my Yale colleagues has publicly intimated that I am a zealot who is perpetrating a dangerous hoax and conspiracy theory. I have been attacked in news articles by journalists who, ignorant of the full picture, have spun hit pieces from cherry-picked sources.

These personal attacks are a dangerous distraction from the real issue of hydroxychloroquine's effectiveness, which is solidly grounded in both substantial evidence and appropriate medical decision-making logic. Much of the evidence is presented in my articles.

To date, there are no studies whatsoever, published or in pre-print, that provide scientific evidence against the treatment approach for high-risk outpatients that I have described. None. Assertions to the contrary, whether by Fauci, the FDA, or anyone else, are without foundation. They constitute misleading and toxic disinformation.

What do you need to know to evaluate these smears against hydroxychloroquine? The first thing to understand is that COVID-19 has two main stages. At the first stage, it is a flu-like illness. That illness will not kill you. If you are a high-risk patient and begin treatment immediately, you will almost certainly be done with it in a few days. When not treated, high-risk patients may progress. The virus then causes severe pneumonia and attacks many organs, including the heart. In this second stage, hydroxychloroquine is not effective.

So, if you are told that hydroxychloroquine doesn’t work, ask this question: In which patients? Does it not work in those who have just started to have symptoms, or those sick enough to require hospitalization?

The second thing to know is that most low-risk patients survive without treatment. Low risk means you are under age 60 and have no chronic conditions such as diabetes, obesity, and hypertension, have no past treatment for cancer, are not immunocompromised, etc. High risk means you are over 60 or you have one or more of those chronic conditions. High-risk patients need immediate treatment when they first show symptoms. One should not wait for the COVID-19 test result, which can take days and can be wrong. Again, when Fauci and others say that randomized controlled trials show no benefit for hydroxychloroquine, you must ask: In which group of patients?

Every randomized controlled trial to date that has looked at early outpatient treatment has involved low-risk patients, patients who are not generally treated. In these studies, so few untreated control patients have required hospitalization that significant differences were not found. There has been only one exception: In a study done in Spain with low-risk patients, a small number of high-risk nursing home patients were included. For those patients, the medications cut the risk of a bad outcome in half.

I reiterate: If doctors, including any of my Yale colleagues, tell you that scientific data show that hydroxychloroquine does not work in outpatients, they are revealing that they can’t tell the difference between low-risk patients who are not generally treated and high-risk patients who need to be treated as quickly as possible. Doctors who do not understand this difference should not be treating COVID-19 patients.

What about medication safety? On July 1, the FDA posted a “black-letter warning” cautioning against using hydroxychloroquine “outside of the hospital setting,” meaning in outpatients. But on its website just below this warning, the FDA stated that the warning was based on data from hospitalized patients. To generalize and compare severely ill patients with COVID-induced pneumonia and possibly heart problems to outpatients is entirely improper.

In fact, the FDA has no information about adverse events in early outpatient use of hydroxychloroquine. The only available systematic information about adverse events among outpatients is discussed in my article in the American Journal of Epidemiology, where I show that hydroxychloroquine has been extremely safe in more than a million users.

It is a serious and unconscionable mistake that the FDA has used inpatient data to block emergency use petitions for outpatient use. Further, already back in March, the FDA approved the emergency use of hydroxychloroquine for hospitalized patients, for whom it is demonstrably less effective than for outpatients. If hydroxychloroquine satisfied the FDA criteria for emergency inpatient use in March, it should more than satisfy those criteria now for outpatient use, where the evidence is much stronger.

I can only speculate about the cause of the FDA’s recalcitrance. Hydroxychloroquine is an inexpensive, generic medication. Unlike certain profit-generating, patented medications, which have been promiscuously touted on the slimmest of evidence, hydroxychloroquine has no natural financial constituency. No one will get rich from it.

Further, it seems quite possible that the FDA, a third of whose funding comes from drug companies, is under intense pressure from those companies to be extremely conservative in its handling of hydroxychloroquine. If hydroxychloroquine is used widely and comes to be recognized as highly effective, the markets for expensive and patented COVID-19 medications, including intravenous drugs that can only be used in the hospital, will shrink substantially.

Whatever the reason for the FDA’s stonewalling on hydroxychloroquine, this much is certain: Americans are dying unnecessarily, the economy is in disarray, and the threads that bind our society together have frayed. I am speaking out, but where is everyone else? Where are our elected officials, including those who are themselves physicians? Some, including Rep. Andy Biggs of Arizona, have been discussing evidence of the drug's effectiveness, but where are the rest?

This issue should not be a partisan one. If our elected officials are not willing to pry open the FDA, we must elect new officials. Why are we silent? The time to speak is now.

Harvey Risch, M.D., Ph.D., is a professor of epidemiology at Yale School of Public Health.

[John Vosilla] How dare PBS do their job and ask relevant questions to the most powerful democr...

How dare PBS do their job and ask relevant questions to the most powerful democrat

twitter.com

[John Vosilla] It’s all about keeping the super spreaders and those most vulnerable isolated. ...

It’s all about keeping the super spreaders and those most vulnerable isolated. . Perhaps it was because rioters in his city trashed and looted the downstairs to his apartment complex. Gallant arrived back at his apartment this weekend to find it vandalized and looted.

"I feel like I need to buy a firearm, because clearly this is going to keep happening. Enough is enough," he wrote in a subsequent Tweet. "Really angry right now," he continued.

"Great job assholes," he wrote in a subsequent Tweet.

Naturally, Gallant, who once thought he had "dunked" on President Trump, spent most of the weekend being dunked on by the internet for his own hypocrisy.

Recall, this isn't the first we've seen of hypocrisy in Seattle. Basically, any critique of dominant institutions can be smeared as conspiracy theory. There is actually a perverse truth in this smear. For example, if you believe that glyphosate is actually dangerous to human and ecological health, then you also must, if you are logical, believe that Bayer/Monsanto is suppressing or ignoring that information, and you must also believe that the government, media, and scientific establishment are to some extent complicit in that suppression. Otherwise, why are we not seeing NYT headlines like, “Monsanto whistleblower reveals dangers of glyphosate”?

Glyphostate one of the hidden poisonous triggers of this pandemic few talk about... The post accused Jews of conspiring to oppress African-Americans.

"The white Jews knows that the Negroes are the real Children of Israel and to keep Americas secret the Jews will blackmail America,” the post said. Jackson pulled the quotation from “Jerusalem,” a book by Dennine Barnett.

Responding on Twitter to critics of his behavior, Jackson wrote, "ANYONE WHO FEELS I HAVE HATE TOWARDS THE JEWISH COMMUNITY TOOK MY POST THE WRONG WAY I HAVE NO HATRED IN MY HEART TOWARDS NO ONE."

Jackson also shared a clip of a speech featuring Louis Farrakhan accusing Dr. Anthony Fauci and Bill Gates of contriving to "depopulate the Earth" with a vaccine for the coronavirus. Said Jackson in response to Farrakhan’s conspiracy theory: "This man powerful. I hope everyone got a chance to watch this! Don’t be blinded. Know what’s going on!"

Louis Farrakhan has his own history of broadcasting his affinity for Adolf Hitler. In a sermon delivered on March 11, 1984 in Chicago, Farrakhan praised Hitler for being a "great man." At the time, Farrakhan was supporting Jesse Jackson’s 1984 presidential campaign, and although Jackson condemned the content of the remarks, he "refused to renounce Farrakhan’s political support" to preserve his status as a campaign "surrogate."

DeSean Jackson has since deleted the posts of Louis Farrakhan and Dennine’s book from his Instagram page. And in his apology video released on Tuesday, he professed regretting "posting anything that Hitler did." He was, he continued, "just trying to uplift the African American community" and "enlighten my people." Jackson did not say unequivocally that the conspiracies he promoted are untrue.

Jackson’s posts emerged several weeks after New Orleans Saints quarterback Drew Brees was widely criticized by his peers and forced several times to apologize for saying he will “never agree with anybody’s disrespecting the flag of the United States.” Brees was called "beyond lost" by San Francisco 49ers cornerback Richard Sherman. Philadelphia Eagles cornerback Malcolm Jenkins said Brees’ "insensitivity" made him "part of the problem."

The silence of NFL players caused Matthew Berry, a senior sports analyst at ESPN, to ask on Twitter, "Has any current NFL player come out yet denouncing Desean Jackson?"

"I haven’t seen anyone," Berry continued, "but maybe I missed someone. You are either against all hate or you are not. It's not a pick and choose proposition."

As of Tuesday, neither Sherman nor Jenkins have condemned Jackson’s remarks. Stephen Jackson maintained that Desean Jackson is "speaking the truth" and "speaking the facts that he know."

The Philadelphia Eagles did call out Desean Jackson, however. A statement released on Tuesday by the organization said:

Block quote: "We have spoken with DeSean Jackson about his social media posts. Regardless of his intentions, the messages he shared were offensive, harmful, and absolutely appalling. They have no place in our society and are not condoned or supported in any way by the organization. We are disappointed and we reiterated to DeSean the importance of not only apologizing, but also using his platform to take action to promote unity, equality, and respect. We are continuing to evaluate the circumstances and will take appropriate action. We take these matters very seriously and are committed to continuing to have productive and meaningful conversations with DeSean, as well as all of our players and staff, in order to educate, learn, and grow."

But not everyone is happy to see Jackson held to account for promoting hate. Producer and conspiracy theorist Tariq Nasheed said on Tuesday, "Understand the con game the dominant society is playing with DeSean Jackson right now. What he posted wasnt 'bigoted.' And the dominant society knows this. But they are using the ‘I’m white & I say so’ rule to interpret it as bigoted, so they can justify their own anti-Blackness."

It’s not yet clear if or how the Eagles plan to punish Jackson for his behavior.

[Broken_Clock] Frederick Douglass Foundation chairman suggests Dem Part...

Frederick Douglass Foundation chairman suggests Dem Party more systemically racist than police

Black conservative Kevin McGary also suggests Trump support among African-American voters will grow this election over 2016.

Image

Democratic Party donkey symbol in October 2016
(Leigh Vogel/WireImage via Getty Images)

By Alex Nitzberg

Last Updated:
July 7, 2020 - 11:30pm

The conservative head of a foundation honoring the famed abolitionist Frederick Douglass is rejecting the notion that systemic racism pervades America's police forces, suggesting instead there is more evidence of systemic racism in the liberal bastions of the Democratic Party and Planned Parenthood.

During an interview on the "John Solomon Reports" podcast, Kevin McGary, the chairman of the Frederick Douglass Foundation of California, questioned the claim that systemic racism prevails among police when so many minorities populate law enforcement's ranks.

Instead, he said that the description of systemic racism could be applied to the Democratic Party, which he said "started slavery and segregation and to this very day they actually encourage the black genocide of black babies." He also said that "all of their upper echelon, meaning in the House and the Senate, are white, and has been for decades, many decades, probably forever."

He said that a "sincere leftist-Marxist" would express opposition to the Democratic Party.

"But if you're sincere you would immediately begin to march on Washington against the Democrat Party. At the very least you would say, we want reparations, not from the U.S. in general but from the Democrat Party. They're the party that precipitated all this," he said.

Discussing the late founder of Planned Parenthood, McGary said that Margaret Sanger's "racial hatred towards blacks is unparalleled" and he said that "her organization specifically targets to this very day black babies" through its abortion programs.

McGary said that while black women of child-bearing age make up a small proportion of the population, a significant quantity, "over 90 percent in some estimates, of Planned Parenthood and affiliates are actually in the black community. Why? Why would you put all of your sites in the black community for a three percent demographic? This makes no sense," he said.

Planned Parenthood has long defended its founder, Sanger, who was a proponent of the turn-of-the-century science movement known as eugenics that advocated breeding humans with superior qualities. Sanger's writings included statements such as “the most urgent problem today is how to limit and discourage the over-fertility of the mentally and physically defective" and that "we do not want word to go out that we want to exterminate the Negro population."

Planned Parenthood has said it does not believe Sanger's comments were meant to be racist and noted Martin Luther King Jr. was accepted an award in Sanger's name.

McGary predicted that during the upcoming 2020 presidential election President Trump will secure a larger share of support from black voters than he earned during the 2016 election cycle.

Regarding the key question that will characterize this year's election, he remarked, "The question is: Do you want the ideal of America, the free, the righteous, the just-type America or do you want a new sort of reimagined America that embraces something that is anathema to our Constitution, that would be Marxism."

[Broken_Clock] (IMO, Hawaii's unemployment rate is far higher than 22%. They are all states with Democratic governors, with the exception of deep-blue Massachusetts with its liberal Republican governor, Charlie Baker.

Ranked from highest to lowest they are Nevada (25.3%), Hawaii (22.6%), Michigan (21.2%), California (16.3%), Rhode Island (16.3%), Massachusetts (16.3%), Delaware (15.8%), Illinois (15.2%), New Jersey (15.2%), Washington (15.1%).

The five states with the lowest unemployment rates are all red states – most of which never shut down at all. These are Nebraska (5.2%), Utah (8.5 %), Wyoming (8.8%), Arizona (8.9%), and Idaho (8.9%).

This is exactly as Arthur Laffer and I predicted in a study we conducted back in March on the economic effects of lockdowns. States with very strict business shutdown and stay-at-home orders would be facing a much tougher recovery period than states that never shut down, like Utah and Wyoming, and states that rapidly reopened, such as Arizona. This would be a bifurcated red state, blue state recovery – and so it is, so far.

This is not a coronavirus recession. It is a blue state lockdown recession. Democrats say they have shut down their economies to maintain the safety of their citizens. But that is a stretch. Studies are now finding that the negative health effects from the lockdown (suicide, delayed treatments for cancer and heart problems, depression, spousal abuse, alcohol and drug overdoses, to name a few) could easily match the saving of lives from lockdowns.

But there is a much bigger problem with this argument. It is factually untrue that blue states did a better job than red states in keeping their citizens safe. They didn’t. The 10 states with the highest death rates from coronavirus (as a percentage of the state population) are all states with Democratic governors. A blue state resident was twice as likely to die from the virus as a red state resident even though the red states were not heavy-handed in locking down their economies. (Population density likely factored in as well.)

The tragedy for blue state America is that these states – especially in the Northeast and Midwest – were already seeing major outmigration of families, businesses, and capital before the pandemic. The blue state governors’ mishandling of the crisis has only put these states in deeper holes.

Of course, the Democrats are now saying that the caseloads are climbing in the red states. That’s true, but caseloads don’t tell us much of anything. If going outside and gathering in public while ignoring social distancing orders is the reason for the increase in cases (and in some cases hospitalization rates) then we would expect to see a surge in cases in New York, Los Angeles, Chicago, Portland, Seattle, Minneapolis, and Washington, D.C. That is where the largest, and most prolonged, George Floyd protests took place.

So the blue states have not only failed to keep their citizens safe, they’ve ruined their economies as well. Democrats are promising to make America look more like New Jersey, Washington, and California. God forbid. FBI supervisors overruled the agent's recommendation.

Strzok’s notes appear to quote then-FBI Director James Comey as suggesting that Flynn’s intercepted calls with Russian ambassador Sergey Kislyak “appear legit,” bolstering other recently disclosed evidence showing the bureau saw nothing wrong with Flynn’s behavior.

The notes also suggest Biden — who once claimed he had no knowledge of the Flynn probe — raised the issue of the Logan Act, an obscure, centuries-old law, as a possible avenue for continuing to investigate Flynn.

And Strzok appears to quote Obama as suggesting the FBI assign “the right people” to pursue the case.

You can read the notes here:

File
231-1.pdf

These conversations, if accurately portrayed in the Strzok notes, occurred during the same three-day period in which FBI supervisors overruled their field agent’s recommendation to shut down the Flynn case and pivoted toward the strategy of luring Flynn into an FBI interview where he might be caught lying.

Sidney Powell, Flynn’s lawyer, laid out the potential ramifications of the notes in a court filing on Wednesday, calling the new evidence “stunning and exculpatory.”

“Mr. Obama himself directed that ‘the right people’ investigate General Flynn. This caused former FBI Director Comey to acknowledge the obvious: General Flynn’s phone calls with Ambassador Kislyak ‘appear legit,’” Powell argued in her new motion.

“According to Strzok’s notes, it appears that Vice President Biden personally raised the idea of the Logan Act. That became an admitted pretext to investigate General Flynn,” she added.

You can read her filing here:

File
231.pdf

The notes are unlikely to have a substantial impact on the outcome of Flynn’s case because a three-judge appeals court panel in Washington earlier Wednesday ordered U.S. District Judge Emmet Sullivan to immediately dismiss Flynn’s prior conviction for lying to the FBI.

Even if the rebuked judge appeals the decision or the full appeals court reconsiders the case, Flynn is likely on a path to being a free and innocent man.

The real impact of the notes may be on the Justice Department’s ongoing investigation of the Russia investigators, where U.S. Attorneys John Durham and Jeff Jensen are determining whether the FBI or others committed crimes in deceiving the courts or Congress about the evidence in the now-discredited Russia collusion allegations.

A former senior FBI official told Just the News that Strzok’s notes about the White House meeting are a red flag that the Comey-led bureau may have been involving itself illegitimately in a political dispute between the outgoing Obama administration and incoming Trump administration.

“It was a political meeting about a policy dispute, and the bureau had no business being involved,” Former Assistant Director for Intelligence Kevin Brock said. “No other FBI director would ever have attended such a meeting.

“Comey is quoted in the notes as saying the Kislyak call appeared legit. At that point he should have gotten up and left the room," Brock added. "The FBI had no business being represented in that meeting. It did not have a counterintelligence interest any longer.”

A second impact of the notes could be on the campaign trail. A few months ago, Biden claimed he was unaware of the Flynn probe as he was leaving the VP’s office.

“I know nothing about those moves to investigate Michael Flynn,” he said.

He then clarified his denial.

“I was aware that … they asked for an investigation,” Biden said. “But that’s all I know about it, and I don’t think anything else.”

If Powell’s interpretation of the notes is correct, Biden was knowledgeable enough to suggest a possible pretext for continued investigation, the Logan Act. And he eventually unmasked one of Flynn's intercepted phone calls a week later.

Former House Intelligence Committee Chairman Devin Nunes told Just the News on Wednesday the newly discovered notes affirm his long-held suspicion that the Obama White House was trying to influence the FBI’s Russia probe in untoward ways.

“Now we know both Obama and Biden were directly involved in planning the attack on Flynn,” Nunes said. “The Obama administration exploited our intelligence community to spy on their political opponents and engineer bogus investigations and prosecutions of them.

“This is the single biggest abuse of power I’ve seen in my lifetime,” he adde

[Broken_Clock] when it comes to wall st., there are no "liberals" bloomberg.com Supreme Court N...

when it comes to wall st., there are no "liberals"
bloomberg.com
Supreme Court Narrows Power of SEC to Recoup Illegal Gains By
Greg Stohr

June 22, 2020, 4:04 AM HST Updated on June 22, 2020, 8:49 AM HST

Court trims SEC ability to win ‘disgorgement’ in federal court

Sotomayor says disgorgement must be for compensating victims

The U.S. Supreme Court limited the power of the Securities and Exchange Commission to recoup illegal profits from wrongdoers, putting new curbs on one of the agency’s most potent legal weapons.

The 8-1 ruling Monday preserved the SEC’s power to win “disgorgement” in federal court so long as the money is used to reimburse defrauded investors and doesn’t exceed the wrongdoer’s net profits. But the court also suggested that federal law bars awards from going further, blunting a legal tool that critics say the agency has abused.

The SEC typically wins more than $1 billion a year in disgorgement orders in federal court. Disgorgement is a traditional tool used by judges to return wrongful gains to the victims. It’s distinct from SEC fines, which the agency is allowed to use as punishment.

Writing for the court, Justice Sonia Sotomayor said Congress had prohibited the SEC from seeking disgorgement “in excess of a defendant’s net profits from wrongdoing.” She said courts must subtract “legitimate expenses” before ordering disgorgement.

The ruling is a partial victory for a California couple ordered to pay $27 million after being found to have defrauded investors.

Distribute to InvestorsSotomayor also said disgorgement awards must be geared toward compensating investors, rather than simply stripping wrongdoers of their profits. She said it was an “open question” whether the SEC can deposit recouped money in the Treasury when it’s not feasible to distribute it to investors.

Disgorgement “must do more than simply benefit the public at large by virtue of depriving a wrongdoer of ill-gotten gains,” she wrote.

In addition, Sotomayor suggested that awards generally must track individual wrongdoing and not try to make one wrongdoer give back benefits an associate received.

Although federal law doesn’t explicitly say the SEC can seek disgorgement, the 2002 Sarbanes-Oxley Act says judges hearing SEC enforcement actions can award “any equitable relief” they deem appropriate to protect investors. Courts have traditionally viewed disgorgement as an “equitable” measure, which means judges make awards based on fairness rather than strict legal rules.

The ruling “will provide defendants strong ammunition for battling back against the SEC’s tendency to seek aggressive disgorgement remedies,” said Howard Fischer, a former SEC trial lawyer and now a partner at Moses & Singer in New York.

‘Existential Threat’But even with the limits, some agency veterans said they see the decision as a victory for the SEC because it formally preserves the enforcement program’s ability to obtain disgorgement. Banning the remedy would have been a major setback for its policing efforts.

“That was the existential threat” that the commission feared, said Stephen Crimmins, a former agency enforcement attorney who is now a partner at Murphy & McGonigle. “This is a big win for the SEC.”

The ruling didn’t directly affect the SEC’s separate authority to seek disgorgement through administrative proceedings.

The couple, Charles Liu and Xin Wang, had asked the justices to go further and bar the SEC from seeking court-ordered disgorgement at all. Liu and Wang said that tool isn’t one of the remedies Congress has authorized the SEC to seek against people who violate the nation’s securities fraud laws.

Sotomayor rejected that contention, saying Congress incorporated the traditional courtroom rule that judges may “strip wrongdoers of their ill-gotten gains.”

Justice Clarence Thomas was the court’s only member who said he would have barred the SEC from seeking disgorgement at all in federal court.

Returning FundsPresident Donald Trump’s administration and the SEC defended the disgorgement power, saying Congress authorized it three times, including in the Sarbanes-Oxley Act.

SEC spokeswoman Chandler Costello said the decision “allows us to continue to strip wrongdoers of their ill-gotten gains and return money to its rightful owners, following the court’s direction to ensure that our efforts embody principles of equity and fairness.”

The SEC says it tries to return disgorged funds to injured investors when possible. The agency says it collected $1.5 billion in disgorgements and penalties in 2019 and paid out $1.2 billion to investors that year.

Liu and Wang were found to have defrauded people seeking to take advantage of a visa program for foreigners who make large U.S. investments. The SEC said Liu and Wang falsely told investors their money would be used for a cancer treatment center.

Liu and Wang said the order in their case went well beyond the $8 million the trial judge found they had gained from their scheme.

The case is Liu v. Securities and Exchange Commission, 18-1501.

[Broken_Clock] justthenews.com Fired NY prosecutor was given Biden-Ukrai...

       justthenews.com

Fired NY prosecutor was given Biden-Ukraine allegations in 2018 but didn’t follow up, emails show

Ukraine prosecutors didn't want the political spectacle that became impeachment and simply sought to turn over evidence about Joe Biden and election interference to U.S. prosecutors, memos show.

By John Solomon

Last Updated:
June 23, 2020 - 11:32am

Could the impeachment scandal have been prevented if the now-fired U.S. Attorney Geoffrey Berman had followed up on Ukrainian allegations about Joe Biden and his family in 2018?

That’s the tantalizing question raised by emails from fall 2018 between an American lawyer and the chief federal prosecutor in Manhattan that were obtained by Just the News.

The memos show that well before Ukrainian prosecutors reached out to Rudy Giuliani, President Trump’s lawyer, in 2019 to talk about the Bidens and alleged 2016 election interference they first approached Berman’s office in New York in October 2018 via another American lawyer.

The memos show Little Rock, Ark., lawyer Bud Cummins, a former U.S. attorney himself, reached out at least five times in October 2018 to Berman seeking to arrange a meeting with then-Ukrainian Prosecutor General Yuriy Lutsenko.

Lutsenko, who emerged as a key figure in the impeachment scandal, wanted to confidentially share with federal prosecutors in New York evidence he claimed to possess that raised concerns about the Bidens’ behavior as well as alleged wrongdoing in the Paul Manafort corruption case.

“Prosecutor General Yuriy Lutsenko is offering to come to U.S. meet with high-level law enforcement to share the fruits of investigations within Ukraine which have produced evidence of two basic alleged crimes,” Cummins wrote Berman on Oct. 4, 2018, one day after the two had talked on the phone about the allegations.

The allegations included that Joe Biden had “exercised influence to protect Burisma Holdings” after his son Hunter and his son’s business partner Devon Archer had joined the Ukrainian gas company’s board of directors and “substantial sums of money were paid to them,” Cummins wrote.

At the time Hunter Biden and Archer joined Burisma in 2014, the company was under criminal investigation in both England and Ukraine for alleged corruption. The British case was dropped in 2015, and the Ukraine cases were eventually settled in the final days of the Obama administration.

Joe Biden boasted during a 2018 public appearance that he forced the firing on Lutsenko's predecessor, Viktor Shokin, back in 2016by threatening to withhold $1 billion in U.S. aid to Ukraine. At the time, Shokin was leading the investigation into Burisma. Biden denies the investigation factored into his decision.

Biden’s and Archer’s firm received more than $3 million in payments from Burisma between 2014 and 2016, bank records obtained by the FBI show.

Records recently released by the State Department also show Hunter Biden and Archer had contacts in 2015 and 2016 with senior State officials, including Secretary of State John Kerry and Deputy Secretary of State Tony Blinken.

In addition, Burisma’s U.S. representatives were lobbying the State Department in Washington and the U.S. embassy in Kiev seeking to make the corruption allegations go away, the State memos released under FOIA show.

“The allegation by Prosecutor General Lutsenko et al is that the US ambassador, Marie L. Yovanovitch, Biden and Kerry made conclusions about who were the good guys and the bad guys in local government. They believe Biden and Kerry were influenced by payments to Hunter Biden and Devon Archer to influence certain decisions, particularly those benefitting Burisma,” Cummins wrote, relaying the allegations from the Ukrainian officials.

In addition, Cummins told Berman that Lutsenko had evidence that a ledger found in Ukraine in 2016 alleging to show payments to Manafort from a Russian-backed political party in Ukraine was doctored and the U.S. knew the evidence was corrupted. The emergence of the ledger caused Manafort to resign as Trump’s campaign chairman in August 2016, and eventually led to his conviction on money laundering and tax charges.

“The second allegation above is that the Embassy and FBI willfully pressured Ukrainian officials to falsify evidence to be leaked to the media about Manafort to affect the outcome of the 2016 election,” Cummins wrote Berman.

Cummins said in an interview he had one phone call and four email contacts with Berman in October 2018 about the Ukrainian matter, but the prosecutor’s office never took Lutsenko up on his offer to come to Washington and lay out his evidence.

“I never heard from them again,” Cummins said of Berman’s office. “It was an opportunity for the Justice Department to address these concerns privately, and who knows how history would have turned out had the SDNY simply followed up.”

Berman, instead, would eventually indict two associates of Giuliani on campaign finance and other charges after they tried to help the former New York City mayor and Trump lawyer publicize the Ukraine prosecutors' concerns. (One of the indicted associates, Lev Parnas, worked as a translator and interview facilitator for this reporter on a handful of Ukraine interviews in 2019, but prosecutors do not allege he did anything wrong in that work.)

James Margolin, a spokesman for the U.S. attorney's office in New York, declined comment Monday when asked about the Cummins overture in 2018.

Cummins said he was not representing Lutsenko as his client, but rather a Ukrainian-American citizen who was trying to help the prosecutor general get information into U.S. authorities' hands.

Cummins’ email states that Lutsenko wanted to meet with Berman because the U.S. attorney’s office in New York had successfully prosecuted Archer on unrelated charges earlier in 2018. Archer’s conviction, however, was overturned by a judge, and Berman’s office never retried the case.

Cummins' efforts to help arrange the meeting were confirmed by one of Lutsenko's deputies, Konstantin Kulyk, who said last year that Ukrainian authorities repeatedly tried to convey evidence about possible wrongdoing by Americans to the U.S. Justice Department but were thwarted.

Lutsenko said in an interview last year that when Cummins’ efforts failed to get an audience with the Justice Department he reached out to Giuliani, hoping to find a different channel to get information investigated.

It was those contacts that eventually spurred the entire impeachment inquiry, which ended in January in the Senate’s acquittal of Trump.

Democrats have tried to portray Giuliani’s activities as an effort to dig up dirt on Trump’s 2020 rival, and to get Ukrainian officials to launch a probe of Biden.

But Cummins’ emails make clear Ukrainian authorities weren’t interested in investigating the Bidens on Ukrainian law violations. Rather, they wanted to confidentially provide evidence of possible violations of U.S. law so American authorities could investigate. And they had no interest initially in involving the Trump White House. Rather, they simply wanted to share evidence with U.S. authorities at the prosecutor-to-prosecutor level.

Cummins’ emails to Berman make clear that Lutsenko did not trust the U.S. embassy in Kiev or the FBI to review the materials, fearing they were too political.

“Lutsenko faces political hurdles in getting a visa to come here. It is believed that the embassy in Kiev has blocked his obtaining a visa in the past. He believes it is because the US ambassador knows the nature of his investigation and wants to obstruct him from coming and sharing it,” Cummins wrote Berman on Oct. 4, 2018.

Five days later, Cummins wrote that Lutsenko was prepared to deliver serious evidence, including copies of two ledgers in the Manafort case that Ukrainian prosecutors believed were faked

“Presumably he will be prepared to discuss eyewitness testimony he believes will corroborate both this story and also the separate bribery allegations,” Cummins wrote.

When Berman stopped responding, Cummins offered to have Lutsenko meet with a lower-ranking federal prosecutor simply to transfer the evidence. “Perhaps you can provide at least one trusted prosecutor and trusted agent to meet with a couple of the actual investigators and just let them take down the information like they would if any citizen walked in the door with some information to share,” Cummins wrote on Oct. 18, 2018.

There was never any further response, Cummins said.

Ukrainian officials have said they did not believe the Bidens broke Ukrainian law but may have engaged in conflicts of interest prohibited by U.S. law. The concerns about the Bidens engaging in conflicts of interest were confirmed by U.S. officials as well.

During impeachment testimony last fall, both Yovanovitch and her top deputy in the Kiev embassy, George Kent, testified that Hunter Biden’s role at Burisma while his father oversaw U.S.-Ukraine policy created the “appearance of a conflict of interest.” Kent said he even tried to raise his concerns with Biden’s VP office but was rebuffed.

All federal officials are required by federal ethics laws to avoid taking actions that create the appearance of a conflict of interest.

[Broken_Clock] summit.news “To preserve the peace and tranquility of residential neighborhoods...

summit.news

“To preserve the peace and tranquility of residential neighborhoods, effective tonight and until further notice, no more than 10 people shall gather in an assembly in a public right of way in a residential area between the hours of 9 p.m. – 8 a.m.,” an announcement proclaimed on the city’s social media accounts.
