The revolution will be televised

Those concerned that the living room sofa is a scene of apathy will be relieved to hear that Virgin is promising that this is the start of a revolution. No more will the British public be bound to the whims of broadcasters, but instead they will be able to pick and choose what they want to watch, record the things that they have missed, enjoy on demand programming, and use web-based applications. And all in glorious 3D, HD, or standard resolution.

"This is a landmark moment in the UK's digital revolution and vividly illustrates why Virgin Media is the only company who can provide the ultimate digital lifestyle," said Cindy Rose, executive director of digital entertainment at Virgin Media. "For the first time, viewers will have a truly personalised viewing experience so they can get the most out of the wonderful worlds of the internet and TV all in one place."

....Helping customers build up this mass of content will be a one terabyte set top box from Tivo that will be able to store as much as 500 hours of standard definition programming. Installation will cost £199 while monthly contracts will run £26.50 per month. Virgin Media will launch the service in mid-December.

Motorola sues TiVo over DVR technology

NEW YORK, Feb 27 (Reuters) - Motorola Mobility <MMI.N> sued TiVo Inc <TIVO.O> for infringing its patents for digital video recorders (DVRs).

Motorola said it was seeking to protect its interests after TiVo sued Verizon Communications Inc <VZ.N>, which uses Motorola's technology, for patent infringement.

In a complaint filed on Friday, Motorola said it acquired its DVR patents through an acquisition of Imedia, which filed for patents in April 1995.

TiVo'S patents used the same technology that Imedia engineers invented years before, Motorola said.

"TiVo is attempting to assert its patents against technology disclosed and claimed in Motorola Mobility's patents, despite the fact that Motorola Mobility's patents were filed more than three years before TiVo's patents," Motorola said in a statement.

TiVo's 4Q Loss, Outlook Disappoint

TiVo (TIVO: 9.06, -0.20, -2.16%) revealed late Tuesday a widened fourth-quarter loss and warned of worse results next quarter and continued litigation costs through 2011, sending its shares nearly 5% lower after hours.

The Alviso, Calif.-based company posted a net loss of $34.4 million, or 30 cents a share, compared with a loss of $10 million, or 9 cents a share, in the same quarter last year, slightly worse than average analysts estimates polled by Thomson Reuters of a 28-cent loss.

Revenue for the provider of digital video recorders for televisions was $41.4 million, the company’s first sequential increase in six quarters, compared with $45.3 million a year ago, just about matching the Street’s view of $41.02 million.

The rise in sales this quarter over last was led by a 30% increase in TiVo-Owned subscriptions, with additions up to 60,000 from 46,000 a year ago, driven by its new pricing options. TiVo-Owned net subscription losses slipped in the quarter to 55,000 from 72,000 losses in the year-earlier period.

Helping the results were continued global expansion and the deployment by Virgin Media of its next-generation TVs powered by TiVo, which will be offered to their roughly four million customers in the U.K., offset by higher costs, many of which were related to its ongoing intellectual property lawsuits.

The company warned that it expects to be engaged in a significant amount of legal activity against EchoStar (SATS: 36.40, -0.40, -1.09%), AT&T (T: 27.89, +0.02, +0.07%), Verizon (VZ: 36.00, -0.06, -0.17%), Microsoft (MSFT: 25.74, -0.23, -0.89%) and Motorola (MMI: 26.93, +0.29, +1.09%) through 2011.

“It goes without saying that there's no change in our view of our intellectual property and the value it could yield for our shareholders,” said Tim Rogers, TiVo chief executive.

Looking ahead, the company anticipates a sequential decrease in revenue to the range of $36 million to $38 million, due primarily to an anticipated $4 million to $5 million decrease in technology sales. Given the weaker revenue, TiVo expects a widened loss next quarter in the range of $35 million to $37 million.

Under the terms of the settlement, DISH Network and EchoStar agreed to pay TiVo $500 million, including an initial payment of $300 million with the remaining $200 million distributed in six equal annual installments between 2012 and 2017. TiVo, DISH Network and EchoStar agreed to dismiss all pending litigation between the companies with prejudice and to dissolve all injunctions against DISH Network and EchoStar.

The parties also granted certain patent licenses to each other. TiVo granted DISH Network a license under its Time Warp patent (US Pat. No. 6,233,389) and certain related patents, for the remaining life of those patents. TiVo also granted EchoStar a license under the same '389 patent and certain related patents, for the remaining life of those patents, to design and make certain DVR-enabled products solely for DISH Network and two international customers. EchoStar granted TiVo a license under certain DVR-related patents for TiVo-branded, co-branded and ingredient-branded products.

TIVO settles with AT&T:

$215MM: TiVo cashes in on AT&T settlement

TiVo is going to get $215 million over the next seven years from AT&T thanks to a settlement of the two companies’ DVR lawsuit. TiVo had sued AT&T in 2009, alleging that the phone company’s DVR violated some of TiVo’s patents. AT&T has now agreed to pay TiVo $51 million up front, as well as a total of $164 million in quarterly payments. AT&T could be forced to pay up even more if its number of DVR subscribers went above a certain threshold, according to a news release issued by TiVo.

We’ve long been arguing that TiVo has been transforming itself from a CE player to a licensing entity. The company has been bleeding end-user subscribers for years, but recently was able to add subscriptions through partnerships with Virgin and RCN. Still, the only way TiVo has really made money in recent years was through patent lawsuits, followed by lucrative settlements. Dish Network and Echostar agreed to pay TiVo a total of $500 million to settle a lawsuit brought against their DVRs last year.

Show’s Title, in Symbols, Defies DVRs

CBS knew that when it ordered a sitcom with a vulgar word in the title, it would get attention. The network also knew there would be some hand-wringing about the coarseness of popular culture.

Here’s what the network did not know: that the title would trip up some digital video recorders. It turns out that the search tools on some DVRs cannot find the new show, “$#*! My Dad Says,” because the symbols cannot be read. (Maybe some DVR developers could not foresee a world where TV shows would have a dollar sign in the titles.) Before the show’s premiere on Thursday, CBS released a viewers’ guide of sorts on Wednesday to help people program their DVRs accordingly.

The case illustrates how some TV networks have embraced the DVR, though tepidly. Despite the commercial-skipping abilities of the recording devices, highly rated shows become even more so when DVR playback is included in the Nielsen ratings that help determine prices for advertising time. About 38 percent of households now have DVRs, though the vast majority of programming is still watched in real-time.

“Obviously, our first choice is that you always watch everything on CBS live; however, we also consider the DVR our friend,” CBS wrote in its viewers’ guide on Wednesday, which was shared on, on Twitter and elsewhere online.

CBS recommended that viewers set “$#*! My Dad Says” to record through the program guide rather than the search tool. Most DVR users already record shows through the program guide, said David Poltrack, the chief research officer for CBS, “but we don’t want to make it difficult for any of our consumers.”

It’s a leave-no-viewer-behind strategy.

The sitcom, which was inspired by a 30-year-old’s profane Twitter feed about his father’s blunt observations, stars William Shatner as the father. Mr. Poltrack observed that on some DVR systems, like the one operated by Time Warner Cable in Manhattan, the symbols in the title are actually an advantage, because the show appears at the top of an alphabetical list of programs.

Though networks say they consider the DVR a friend, time-shifting still causes headaches. Because the media tend to concentrate on overnight ratings for shows, even though millions of people now delay their viewing, shows can appear to be less popular than they actually are.

Partly for that reason, CBS this week started to include projections of the DVR playback of its shows in its statements on overnight ratings. For instance, it projected that Tuesday’s “NCIS” would gain 2.5 million viewers after a week of DVR viewing, a gain of 10 percent.

With the projections, “we can see, directionally, whether a show is growing or declining,” said Mr. Poltrack.
