TiVo's new $99 and 'free' deals are no deal at all

You can now buy a TiVo digital video recorder for just $99 and change. Please don't.

The "special holiday offer" headlined on the Alviso, Calif., company's home page looks like a sizable discount at first. Instead of forking over $299.99 upfront, then paying $12.95 a month in service fees, you can spend $99.99 for the DVR from now through Dec. 31 in return for committing to pay $19.99 a month for service for a year. Or ante up an extra $200 for the higher-capacity Premiere XL recorder and sign up for the same monthly rate.

But TiVo's fine print leaves out an unpleasant provision confirmed by company publicist Lacey Haines in a series of e-mails last week: The $19.99 rate remains in effect forever on those discounted TiVo boxes.

So while you'd be doing well after one year, you'd go underwater not long after two.

Let's do the math. TiVo normally sells its Premiere DVR for $299.99 and charges $12.95 a month for service. That yields a total one-year cost of $455.39. After two years, you'll have spent $610.79; after three, $766.19. If you take the $99.99 offer, your expenses hit $339.87 after one year, $579.75 after two and $819.63 after three.

You'll do better under another, non-XL offer that TiVo doesn't mention on its home or product-information pages: Pay nothing for a Premiere in return for committing to two years of $19.99-a-month payments (after which the $19.99 rate remains bolted to the DVR). Under this offer, you'd pay $239.88 after one year, $479.76 after two and $719.64 after three.

But even that cost outstrips the total expense of paying full retail on a Premiere and then $399 for "lifetime service." (That's supposed to mean "life of that one TiVo box," although I've heard from users who talked TiVo into moving their lifetime service to a new DVR.) This caps your total expenses at $698.99. If you keep a TiVo at least as long as the average computer, the lifetime deal is the best one.

I'm sure it's a coincidence that TiVo's online store doesn't mention the lifetime option unless you click through to a small-type listing of payment plans. That page also notes that if you don't buy a full-price Premiere directly from TiVo, you can pay $129 up front for a year of service, a cheaper option than even lifetime until you begin your fourth year with the DVR.

Only if you retire the TiVo after two years can you guarantee that you'll save money on the free offer--and that's assuming that TiVo will offer the same no-money-down deal on a new model in 2012.

As veteran video blogger Dave Zatz noted over the weekend, TiVo has experimented with this kind of promotion before. In September, the company briefly offered the same deals--and it didn't explain the $19.99/month lock-in any better back then.

Maybe this time, TiVo will realize that modeling pricing strategies after the kookier extremes of wireless carriers is no way to build a business.

If you're like most iPad users, then you probably surf the web and check out IMDB with your iPad while watching anything that might be showing on the television. TiVo knows this, embraces this, and wishes to support this. They want to make the experience between your television and your iPad even closer.

TiVo announced Monday a new, upcoming iPad app that will let you use many features of the TiVo service all on your iPad, without ever interrupting what's happening on your larger television screen.

The TiVo iPad application will allow you to browse TiVo's program guide, schedule recordings, remotely control your TiVo unit, and browse your library of recorded shows. Additionally, the app will search both broadcast TV and premium services like Netflix, let you check out the cast and crew information of any shows you're watching, as well as schedule shows to be recorded while you're on the road.

Upcoming does mean that it's not out yet, but TiVo says we'll be notified in the customer newsletter as soon as the app is available. It will be interesting to get our hands on the TiVo app since it really could open up a lot of powerful features.

Those concerned that the living room sofa is a scene of apathy will be relieved to hear that Virgin is promising that this is the start of a revolution. No more will the British public be bound to the whims of broadcasters, but instead they will be able to pick and choose what they want to watch, record the things that they have missed, enjoy on demand programming, and use web-based applications. And all in glorious 3D, HD, or standard resolution.

"This is a landmark moment in the UK's digital revolution and vividly illustrates why Virgin Media is the only company who can provide the ultimate digital lifestyle," said Cindy Rose, executive director of digital entertainment at Virgin Media. "For the first time, viewers will have a truly personalised viewing experience so they can get the most out of the wonderful worlds of the internet and TV all in one place."

....Helping customers build up this mass of content will be a one terabyte set top box from Tivo that will be able to store as much as 500 hours of standard definition programming. Installation will cost £199 while monthly contracts will run £26.50 per month. Virgin Media will launch the service in mid-December.

Motorola sues TiVo over DVR technology

NEW YORK, Feb 27 (Reuters) - Motorola Mobility <MMI.N> sued TiVo Inc <TIVO.O> for infringing its patents for digital video recorders (DVRs).

Motorola said it was seeking to protect its interests after TiVo sued Verizon Communications Inc <VZ.N>, which uses Motorola's technology, for patent infringement.

In a complaint filed on Friday, Motorola said it acquired its DVR patents through an acquisition of Imedia, which filed for patents in April 1995.

TiVo'S patents used the same technology that Imedia engineers invented years before, Motorola said.

"TiVo is attempting to assert its patents against technology disclosed and claimed in Motorola Mobility's patents, despite the fact that Motorola Mobility's patents were filed more than three years before TiVo's patents," Motorola said in a statement.

TiVo's 4Q Loss, Outlook Disappoint

TiVo (TIVO: 9.06, -0.20, -2.16%) revealed late Tuesday a widened fourth-quarter loss and warned of worse results next quarter and continued litigation costs through 2011, sending its shares nearly 5% lower after hours.

The Alviso, Calif.-based company posted a net loss of $34.4 million, or 30 cents a share, compared with a loss of $10 million, or 9 cents a share, in the same quarter last year, slightly worse than average analysts estimates polled by Thomson Reuters of a 28-cent loss.

Revenue for the provider of digital video recorders for televisions was $41.4 million, the company’s first sequential increase in six quarters, compared with $45.3 million a year ago, just about matching the Street’s view of $41.02 million.

The rise in sales this quarter over last was led by a 30% increase in TiVo-Owned subscriptions, with additions up to 60,000 from 46,000 a year ago, driven by its new pricing options. TiVo-Owned net subscription losses slipped in the quarter to 55,000 from 72,000 losses in the year-earlier period.

Helping the results were continued global expansion and the deployment by Virgin Media of its next-generation TVs powered by TiVo, which will be offered to their roughly four million customers in the U.K., offset by higher costs, many of which were related to its ongoing intellectual property lawsuits.

The company warned that it expects to be engaged in a significant amount of legal activity against EchoStar (SATS: 36.40, -0.40, -1.09%), AT&T (T: 27.89, +0.02, +0.07%), Verizon (VZ: 36.00, -0.06, -0.17%), Microsoft (MSFT: 25.74, -0.23, -0.89%) and Motorola (MMI: 26.93, +0.29, +1.09%) through 2011.

“It goes without saying that there's no change in our view of our intellectual property and the value it could yield for our shareholders,” said Tim Rogers, TiVo chief executive.

Looking ahead, the company anticipates a sequential decrease in revenue to the range of $36 million to $38 million, due primarily to an anticipated $4 million to $5 million decrease in technology sales. Given the weaker revenue, TiVo expects a widened loss next quarter in the range of $35 million to $37 million.

ALVISO, CA and ENGLEWOOD, CO--(Marketwire - 05/02/11) - TiVo Inc. (NASDAQ:TIVO - News), DISH Network Corporation (NASDAQ:DISH - News), and EchoStar Corporation (NASDAQ:SATS - News) announced today that they have settled all of their ongoing patent litigation.

Under the terms of the settlement, DISH Network and EchoStar agreed to pay TiVo $500 million, including an initial payment of $300 million with the remaining $200 million distributed in six equal annual installments between 2012 and 2017. TiVo, DISH Network and EchoStar agreed to dismiss all pending litigation between the companies with prejudice and to dissolve all injunctions against DISH Network and EchoStar.

The parties also granted certain patent licenses to each other. TiVo granted DISH Network a license under its Time Warp patent (US Pat. No. 6,233,389) and certain related patents, for the remaining life of those patents. TiVo also granted EchoStar a license under the same '389 patent and certain related patents, for the remaining life of those patents, to design and make certain DVR-enabled products solely for DISH Network and two international customers. EchoStar granted TiVo a license under certain DVR-related patents for TiVo-branded, co-branded and ingredient-branded products.
