"Varian argues that Delfino’s free speech on public issues is somehow something other than that. The trial court was presented with a chart that showed the chronological listing dates, events, significance and issues that the postings related to (AA Vol 10, p 2608-2612). It was clearly demonstrated how the postings, such as the “manipulative liar, or worse yet, neurotic hallucinator,” were in the context of the false harassment accusations presented by Varian to the CUIAB and EDD for determination of Delfino’s unemployment benefit claim. Delfino has steadfastly maintained he did nothing to harass Felch. He had actually filed an harassment claim with Varian asking that Felch leave Delfino alone. Felch convinced Varian that she if that put a secret video camera in place, it would support her accusations against Delfino. Five weeks of 24 hour videotaping later, she still had no evidence of this “repeated” harassment. And what was this harassment? Sexual groping? Offensive touching? Destruction of property? Throwing objects at Felch? Interference with her walks through the plan? Unauthorized entry into Felch’s office or lab? No. Her claim of harassment was 1) Delfino avoided her, 2) he made faces at her, and 3) he made some kind of “on the telephone” hand gesture towards her. That’s it. $2,000,000 dollars later, we’re litigating whether Delfino was somehow, and in some manner, “rude” to Felch. That is the “meat” of this “burger.” Varian’s own in-house investigation of Felch’s claims, including 5 weeks of video surveillance and interviews of the purported witnesses, failed to obtain even one witness, one document, or one fact to substantiate Felch’s rudeness claims. And that was Varian’s best case (which they lost at the CUIAB hearing) "
