If you are questioning the use of viability as the criteria, then you are correct; it may no longer be 23 weeks. The determination of viability to be 25 weeks was determined in the 70s. Now we have seen babies survive as early as 19 weeks, though I think that is very rare. At 24 weeks, there is about a 40% chance of surviving, but by 28 weeks, it's 90% according to one source I found. Of course, this is just measuring the success of medical science, not the intrinsic nature of a fetus as human.
But lowering the viability standard won't begin to satisfy anyone who believes that the fetus is a human being with rights at conception.
