Kenneth, Today, I spoke to a speaker from the Missouri Dept of Health and Senior Services. We got into the discussion of what impact would be the result if the Healthcare Bill was overturned as being outside the US Constitution. His and other healthcare hospital and doctors have indicated to me, "there would be a big mess in the healthcare industry since a large portion of the bill is already in place, ie. 26 year old individuals under their parents healthcare policy, pre-existing condition clauses, payment this past year to those on medicare part D, and other items on the bill." Also, rejection would establish a negative past practice for other laws where the commerce clause was used to implement Federal Laws on individuals and State. These laws then could be over turned. What we have in this situation is the "law of un-intendent consequences."

From you knowledge of the law, what past laws passed by the Fed. could possibly be re-addressed and overturned if a conservative court choice to over turn previous laws on Constitutional grounds?

That is why there is a big mess in the healthcare industry now. You cannot slop together an incredibly huge bill and pass it without reading it and expect it to be functional, no less responsible. Nobody involved in the making of the bill even had an overall view of anything but their own particular interest. They passed a bill that they had no idea what was in it. One thing is clear and that is the bill offers unprecedented control over the economy and the country as a whole.

You ask Kenneth with his knowledge of the law...ROFLMAO!! If you want the reaction or opinion of attorneys you should post of Politics for Pros as there are at least 5 experienced attorneys who do post there.

The ban on birthdays is over in the Big Apple.

The New York City Department of Education has decided against going forward with its plan to ban the use of 50 words on standardized school tests, thinking the terms might be offensive to some people.

Among the words on the forbidden list were birthdays, celebrities, cigarettes, crime, divorce, evolution, politics, sex and religion

The recommendation was originally made last week, and New York Schools Chancellor Dennis Walcott told WCBS-TV his department was simply giving guidance to the test developers.

“So we’re not an outlier in being politically correct. This is just making sure that test makers are sensitive in the development of their tests,” Walcott said.

Words suggesting wealth were also excluded because they could make kids jealous.

“Poverty” was also on the forbidden list, and Sy Fliegal with the Center for Educational Innovation told WCBS that was ridiculous.

“The Petersons take a vacation for five days in their Mercedes … so what? You think our kids are going to be offended because they don’t have a Mercedes? You think our kids are going to say ‘I’m offended; how could they ask me a question about a Mercedes? I don’t have a Mercedes!’” Fliegal said.

After an uproar from parents over the proposed ban, the DOE backed down, but the department released a statement saying it would “continue to advise companies to be sensitive to student backgrounds” and “avoid unnecessary distractions that could invalidate test scores.”



The words on the original forbidden list include:

Abuse (physical, sexual, emotional, or psychological)

Alcohol (beer and liquor), tobacco, or drugs

Birthday celebrations (and birthdays)

Bodily functions

Cancer (and other diseases)

Catastrophes/disasters (tsunamis and hurricanes)

Celebrities

Children dealing with serious issues

Cigarettes (and other smoking paraphernalia)

Computers in the home (acceptable in a school or library setting)

Crime

Death and disease

Divorce

Evolution

Expensive gifts, vacations, and prizes

Gambling involving money

Halloween

Homelessness

Homes with swimming pools

Hunting

Junk food

In-depth discussions of sports that require prior knowledge

Loss of employment

Nuclear weapons

Occult topics (i.e. fortune-telling)

Parapsychology

Politics

Pornography

Poverty

Rap Music

Religion

Religious holidays and festivals (including but not limited to Christmas, Yom Kippur, and Ramadan)

Obama (THE TOTAL FAILURE AND CONSTITUTIONAL DUMMY), along with that racist DOJ Holder, promised it would be in NYC didn't they?

Now that Guantanamo is closed, as they promised the American people, where will the trial be held?
