Thanks Art and Web, though it appears real time quotes are still available if you pay for IQ Chart. Moving a feature from the base offering that thousands paid 200 bucks for to a for-charge offering is a form of bait and switch and unethical at least, if not illegal. I intend to complain to SI and will not spend as much time here anymore since I need real-time quotes and info and get it already from other services. Too bad.

Hi Paul,

You state:
> I hear out of Big Blue, an earnings warning and layoffs are likely to be announced soon...

One question: Where exactly do you hear an earnings warning and layoffs?

With all due respect, do you hear things in general, or did you hear tthis on Oprah, or was it the psychic hotline, or did stars in the sky relate this info to you?

I just find it absolutely amazing that anyone can start a rumor (and I mean any rumor) on a message board such as Yahoo (where I believe the source of your hearing might be coming from - but then again I maybe wrong), and then it gets around all over the web like a virus!

Considering this, maybe I should start buying the Yahoo stock! What do you think?!

From someone high up in corporate; I can't give the title. I posted it because it was coming from a pretty reliable place and seemed to be very strong, and was curious if others had heard the same. Am neither long nor short IBM, and you can do with the information what you want. You can even buy YHOO.

I see that you are "Founder and editor...", so that any comment from a high up corporate would be in violation of reg FD which could cost the company a fine and the individual their job. Somehow you have failed to convince me, not that that matters at all. Just do a favor to your high up corporate, stop putting their job in harms way.

William

Dear Paul:

You state:
> I posted it because it was coming from a pretty reliable place and seemed to be very strong, and was curious if others had heard the same.

A couple of points:

a) If it is coming from a very reliable high place within IBM, then why on earth do you care and curious if others (the regular Joe on the street) had heard the rumor. In otherwords if you have heard it from a reliable high IBM source, then it no longer is a rumor. And considering you are a cyber journalist (but a Journalist nevertheless) you should also post that on your web sites as well for all to see instead of positing it on a place such SI (or perhaps you already have?).

b) Tell your high IBM corporate contct that SEC will be after both you and him/her, since the kind of information (i.e. earnings warning, and layoffs) you have shared on a message board such as SI is considered to be insider information, and should they become true, I can guarantee that SEC will be coming after both of you (Or at least I will make sure they are aware of this to investigate further).

Sincerely,

I think the First Amendment is a little stronger. And I didn't trade on the information either.

"An issuer's ... communications with the press are outside the scope of Regulation FD."

Good luck. You should take more care not to marry your stocks. But I can see that you've been to Maui and back with this one.

Actually this last time (about 3 weeks ago) it was Waikkiki (its much more fun if you have a kid under 5). Maui is for love birds. :)

Anyway, regarding the IBM rumor (as you were told by your high corporate contact), it may or may not be true. If true, and some investors are pissed off because someone leaked it out I can guarantee SEC will be coming after him/her (they have done this before and if you dont believe it ask your high IBM corporate contact because SEC has gone after the likes of him at IBM at least 4 times during the past 2 years and they ended up paying high fines in addition to doing community work. One of them was fired and the other 3 - to the best of my knowledge - still have their jobs but were demoted).

Anyway... Good Luck! :)

Addi,

In the last two years? What for, and what were the circumstances? Reg FD has only been in place since spring, and I don't see how it applies here, either to me or to the company official. The regulation applies specifically to circumstances of disclosure to analysts or shareholders who might trade on the information. Communication with the press is exempted.

Paul

P.S. I prefer Maui.

Addi, what are you doing arguing when you should be selling?! Or, are you saying that we haven't yet hit the bottom? :-)

Good points Addi. Paul's high up source is obviously not so high up(thats assuming he has a source at all). For one thing I can't imagine anyone high up giving inside info to such a blabber mouth. For another, Paul's "source" doesn't seem at all sure of what he's saying.
