NEW YORK, June 17 (Reuters) - Martha Stewart and her broker differ on the timing of the order to sell her ImClone <IMCL.O> shares, which could potentially be significant to a probe on whether she had inside information regarding the biotechnology firm, the Wall Street Journal reported on Monday.. A person familiar with the events told the Journal that Martha Stewart's broker -- Merrill Lynch's <MER.N> Peter Bacanovic -- said they agreed in mid-December, not late November, to consider selling her ImClone stock if the price fell below $60 a share. The broker's recollection, which the source said was supported by notes he took of the meeting, differs from Stewart's who has publicly said and told congressional investigators that the agreement was struck in late November. Martha Stewart could not be immediately reached for comment. Stewart, chief executive of Martha Stewart Living Omnimedia Inc. <MSO.N>, sold shares of ImClone Systems Inc. in December just the day before the drugmaker's cancer drug Erbitux was rejected by the Food and Drug Administration. Stewart is a former girlfriend of ImClone's ex-chief executive, Sam Waksal. Last week he was taken from his New York home by FBI agents and charged with conspiracy, securities fraud and perjury. According to the report, Bacanovic is a friend of Waksal and is also the broker for Waksal's daughter, Aliza, who investigators say sold ImClone shares after being tipped by her father about the FDA rejection.
