Well it's pretty clear that you could impose a tax and then give a deduction to folks that can have appropriate insurance. That has the identical results, although the optics are of course different. So it's hard for me to see how this is outside the taxing powers of the government.

It's a little hard for Romney to now claim this is a tax when he previously denied that his virtually identical Massachusetts scheme was not a tax. This is pretty clearly still a penalty not a tax as one would normally think of a tax even though according to the court it was imposed under the taxation powers.
