Anybody who knows the ingredients/recipe 'owns' it - that's the difficult bit about any secret - keeping it secret. When it is disclosed, then anybody who wants it can have it for the taking. Providing it isn't patented, of course, and from the story told, it can't be patented now. It was patented, apparently, many years ago, and the patent is now expired and thus in the public domain - free for the taking.
