Natalie Kerris defended the current pricing structure as parallel to Apple's mobile software store. “Just as we have allowed developers to set prices on the App Store, publishers set prices on the iBookstore,” she told the newspaper.

What she is omitting there is that whilst publishers set prices, the apple agreement also means that they maintain those prices and prevent anyone else selling cheaper than apple.


I guess (IANAL) that if Macmillan joined the agreement after it was made between other publishers and apple, with no discussion with the other publishers, they may not be liable for damages but if the agreement itself is deemed illegal they won't be able to maintain it. Plus, for a single publisher to be in that agreement means that all their books will be higher priced than everyone else's so they would lose out. It only works when a large majority of publishers stick to it.



Whatever the legal repercussions in terms of fines and the like it seems to me clear that the agreement and the price fixing is over with.
