It's pretty damn clear to me what the founders meant. I don't know why there's even a question about it. They don't care. There is a question about it because some people don't like what they said. To those people it doesn't matter what the Founders said, it's what they should have said. Their judicial philosophy is to correct those errors. Had the founders been as intelligent (Liberal) as Judges today, they would have written the Constitution correctly. This is the time to correct things. The Courts have the power, the right and the obligation to correct the mistakes of the Founders. The right to privacy (Abortion) was never mentioned in the Constitution, but it should have been, so now it's there. The right to equal protection based on sexual orientation (Marriage)was never mentioned in the Constitution, but it should have been, so now it's there. The Power of the Government to force health care on the individual was never granted under the Constitution, but it should have been. Will it be there? Know who you are dealing with.
