AFAIK Level3 does sell metro DF or WL to third parties. IIRC it has done so with Comcast. So it is not clear to me that his MUST result in an injunction, unless, as you indicated, in certain markets say AboveNet and XO compete and Level 3 would eat both. But then, wouldn't the ILECs have lots of metro DF and WL (this is just a question), so there still would be (formally) competition - or don't they sell it?

wrt GbE I don't know to what extent the ILECs provide this already. So there I could see more danger of an injunction, but at most very short term. Medium and LT I cannot see that VZ or ATT would not provide GbE in the same markets, if they don't do it already.

How do you see that?
