Don, many programmers work for "body shops" that farm them out to companies needing a temporary increase in workforce. These programmers are almost always paid by the hour. During the boom that ended in 2000, many companies had only about 20% dedicated staff, with 80% of the development staff coming from body shops.

Additionally, California passed a law a few years ago that removed programmers from the "exempt" category, and thus requiring overtime pay. I haven't followed this, so I'm not sure if that law was repealed or modified.
